European Fair Trade Advisory Group – the new Class Action and its strategic partner, ITRA.

Please be aware of another Class Action outfit just set up in Malaga, Spain, under the name of the European Fair Trade Advisory Group (EFTAG) SL cold calling timeshare owners offering to them joining a compensation claim against their resorts, and requesting them to attend a meeting in Malaga. The EFTAG also offers to their potential clients to help them to get out of their timeshare liability.

As a timeshare owner if you are contacted by the European Fair Trade Advisory Group, before you decide whether to accept their services or not, you should know the following FACTS:

  1. The European Fair Trade Advisory Group (EFTAG) openly acknowledges having as STRATEGIC PARTNER the European Class Action outfit The International Timeshare Refund Action - ITRA – as it is clearly stated in the homepage of the website of EFTAG’s sister Class Action outfit in Singapore, the Asian Fair Trade Advisory Group – www.ftagasia.com/welcome.html
  2. The STRATEGIC PARTNER of the European Fair Trade Advisory Group, the International Timeshare Refund Action – ITRA – had its TV Ad in the UK banned by the UK Advertising Standards Authority in January 2011, as it was MISLEADING BY OMISSION, because “the ad did not make clear that it was offering another product in addition to the opportunity to join the legal action” and “attendees were offered an alternative to a timeshare product by ClubClass”. ASA did not say it clearly in the adjudication, but the other product offered as the get out strategy was the holiday club membership, Club Class Concierge.

3. The timeshare resale firm ETOO, the European Timeshare Owners Organisation, a FOUNDING MEMBER of ITRA, when the latter it was the International Timeshare Resale Association, before it morphed into the International Timeshare Refund Action in late 2009, had its TV Ad in the UK, banned by the UK Advertising Standards Authority in August 2008, as it was MISLEADING.

As a timeshare owner, cold called at home out of the blue, by a company just legally set up this May in Spain, the European Fair Trade Advisory Group SL, which does not have any business track record whatsoever which claims having as a STRATEGIC PARTNER ITRA, and knowing that the Advertising Standards Authority has banned in the past two TV Ads for being misleading, one of ITRA, and another of one of its founding members, ETOO, when ITRA was a resale organisation, we truly urge caution before accepting any kind of legal representation, by the European Fair Trade Advisory Group, listed at the Spanish Companies House , as provider of promotion services for the real estate industry, and not as provider of legal services.

Finally, be aware that Spanish listed companies providing legal services are forbidden by law to cold call their potential clients!

    We too have had the same cold calls first was in December 2011 said we could not go to Spain. received followup call 28 June 2012 reminding us of the first call saying they had set up temp offices near Chester for those who could not go to Spain. Appointment made for Sunday 15 July we will not be going Many thanks . I will be contacting Trading Standards and register a complaint if we all do this perhaps action by others could start a clamp down. We live in hope of of honest and true options and not being scammed again

    Husband and I went to Bristol Airport yesterday 9 Jun 12 after receiving a cold call and similar letter to John confirming our appointment at the “free registration centre”. After the usual pleasantries we were asked if we wanted to dispose of our timeshare. Of course there was a fee for this (between £4,000 – £10,000). Needless to say, after being associated with Timeshare since 1991 and been had so many times, we declined.

      We have an appointment at Bristol for Friday 8 June, having read previous comments what can we expect? I made made it clear at the initial “cold call” we would not entertain any form of Investment or up front fees, I was “assured ” there would not be any expense of this nature. So, what new angle is this ?

    We had a cold call from EFTAG several weeks ago with the same offer but told them we could not travel to Marbella. However, at the beginning of April EFTAG called us again and said they had set up some appointments in Doncaster, UK for those people who could not travel to Spain. We decided we could manage the trip to Doncaster, so they sent us an emailed letter, like the one John received, with an appointment on Saturday 26 May 12.
    However, since we have also been scammed several times by: DWVC & Cashback (Spain), Club Class Concierge & Cashback (Spain), Worldwide Holidays (Tenerife),Club Class Sarl (Tenerife), Thomas Consulting SL (Spain, who took our money and our points certificates and absconded); we have become cautious. TOO late for the thousands of pounds we have already lost, but we are determined NOT to be scammed again.
    We could not find anything on the internet under EFTAG, but noticed at the bottom of their letter they had put: European Fair Trading Advisory Group.
    This lead us to finding your website and blogs, and we are so happy that we did.
    We will NOT be keeping the appointment with EFTAG in Doncaster! A lucky escape!

      what do you know about Thomas Consulting?Are they in receivership. We bought a Travel Saver membership from them with points and cash. and have been scammed as the product doed not seem to exist. neither does Thomas Consulting any more!

    Had the same cold call from european fair trading, same story as reported by John on 1st March, told the Scottish lady who called that i was not interested in the fairy stories being transmitted. Enid Blyton told better ones.

    my parents went because it was a last resort for them to get any money back when they came back they had paid more money to the european fair trade so is there anything they can do to get money back? wish i had seen this sooner!

    Thank goodness for Mindtimeshare Project and Alberto. Was cold called tonight and I asked them to send an e-mail. Almost exactly as above. Clearly a scam and I will not be traveling to Spain. Thank you! Martin.

    Was cold called also and had the same letter faxed to me. I think this is another scam. Do not get caught. Have lost alot of money in the past. Will not be going to Benalmadena.

    Thanks for the information. We got the following this morning:
    All owners are entitled to take part in this lawsuit, which is on a NO WIN/NO FEE basis and is at no cost to yourself as all costs are being absorbed by the litigation funders.
    Claims have been put to Counsel and they have advised there is a case to answer and compensation is expected to be in the region of anything up to £20,000. You will be entitled to 60% of this compensation, 40% will be retained to repay the sponsors and litigation funders.
    The main points are:
    Maintenance fees increasing year on year and in some cases above inflation.
    Perpetuity clause, there is no ‘get out’ clause, in the event of the owners death, the burden of paying the maintenance fees gets passed onto family members.
    Difficulty in getting promised exchanges.
    Mis-sold timeshare or going through high finance companies to obtain credit.
    Constantly harassed on the telephone by companies offering services because you can’t get the product out of your name.

    Free funding has now been allocated in your name. This covers your one to one meeting with a representative of the Legal Team, your accommodation and registration of your claim.
