La Cascada SL Real Estate from Burgos offering a guaranteed resale

A new consumer alert for yet another dubious Real Estate called La Cascada S.L. with a supposed address in Plaza del Pacifico 7, 09007 Burgos, Spain and telephone numbers +34 698711352 (Spanish mobile) and +34 912 184 219 for fax number. (Area code 91 is Madrid not Burgos)

This company has the usual dodgy way of other dubious companies to cold call timeshare consumers and explains to them how successful they are in reselling and as a matter of fact they have a buyer lined up.

They are very understanding about the fact that a cold call out of the blue for a resale with money going into an escrow account, sounds too good to be true, so they will send off the paperwork first for the consumer to have a look at.

The paperwork has an introduction to what La Cascada S.L. is about, sales of villas, Bungalows, businesses, land and even hotels…and of course timeshare..

They employ high qualified staff to assist the consumer in all the matter related to the sale of his property.

Well sounds all great. Only a shame that the Company registration number they quote on the paperwork is FAKE, the company is not registered at all and there is no Real Estate on the Plaza del Pacifico in Burgos.

In the paperwork they also explain the seller has to pay UPFRONT a 9% of the resale price which will go into an escrow account. That’s another timeshare resale broker who hasn’t heard of the New Timeshare Directive where upfront fees for resale’s are banned!

    I have received many calls from Lewis Bari from La Cascada. He said he had a client wanting to buy a large number of points. I said I was interested in selling but very suspicious of his offer of £29,000 for our 21000 points. I told him repeatedly that I would not pay a fee upfront, which he assured me I wouldn’t.
    Checked his rubbish paperwork out and with the help of this site sent him the following email. Not surprisingly he’s not rung me.

    I have said all along I am very dubious about what you have been offering but was prepared to listen.

    I have now had a chance to read through the information you have provided and am disappointed that despite my saying I will not pay any money up front and you saying I won’t have to, I see there is a 9% fee that I need to deposit in the escrow account if I sign the document.
    Paying money upfront is contrary to the European Timeshare Directive 2008/122/EC.

    The document you have provided does not give any details of the escrow bank you will be using, so I am unable to check out whether this service is included on a relevant Government register, such as the FSA Government register.

    Also page 2 of the agreement asks for my bank account details and this is specifically why sellers use a reliable escrow service, so they don’t have to pass such details onto people or companies they don’t know.

    So I will only be willing to proceed using a recognised escrow service or a solicitor of my own choosing. To back up my decision please refer to :- http://en.wikipedia.org/wiki/Bogus_escrow .

    So I will not be entering into any agreement with La Cascada on the current terms.

    I took a cold call last week. They sent through a document relating to their business with an ISO9001 log on it which looks impressive. However the business I work for is ISO accredited and their didn’t look right, and when I checked it, it is a fake. I then searched the web and found the information on this blog. Thanks.

    i HAVE HAD A COLD CALL FROM THIS “COMPANY” AND THEY SENT A SAMPLE CONTRACT BY WHICH THEY REQUIRED ME TO DEPOSIT 9% OF THE AGREED PRICE (WHICH WAS AWAY ABOVE MY ASKING PRICE AND THEY HAD A BUYER!) AND GAVE THEM THE RIGHT TO ACT AS LEGAL INTERMEDIARIES. MANY THANKS FOR YOUR TIMELY WARNING.

        So having done the research the guy rang me yesterday to close the deal, I asked about the Escrow account and if I could use my solicitor, seems that I can but I have to use their escrow account, it takes too long to get another one approved? Their account is held in some unknown Spanish bank that I have never heard of and when I asked why I had to make the payment they said it was insurance to protect them from me ripping them off? Can you believe. I asked for some names of satisfied customers or testimonials and he offered me his mates phone number! Needless to say I sent them packing but if it was not for blogs like this my father would have been sucked in as they are very convincing. The thing that surprises me is that even after you tell them they have been rumbled they still keep trying to get you to do the deal? Thanks again.

        The people on the phone are either ignorant or too hungry for their commission, I cannot guess another reason for being so insisting when somebody has told you to back off.
        Anyway, you saved yourself the money and the hassle, so that’s a plus at least.

    Hello,

    My father has a timeshare which he would like to dispose of however having been scammed once already I am taking over any of his negotiations.

    Today I have been approached by La Cascada S.L. And as you say a very convincing presentation by their man who came as a cold call, and yep they have sent me a draft sale agreement which states the 9% deposit, This would equate to £810 so if the money is held in an Escrow account how can they get hold of it?
