We would almost say, here we go again, as we have detected a very recent set up company called Notary Obligado, who cold calls timeshare consumers and claims to be able to get them their money refunded through the Spanish Government!

If we alerted about a similar company called Hacienda Services not so long ago http://wp.me/p1kmoi-eT who’s website was fortunately closed down last week http://wp.me/p1kmoi-fD , we now have this company Notary Obligado claiming to be a notary office in Spain handling refund claims. These refunds are paid out by the government from money that is waiting in a bank for consumers to claim…sounds really too good to be true…
The website www.notaryobligado.com was registered on the 30th of January 2012, so very very recent!
Again we find a display of official logos from the Spanish tax offices and obviously this goes against the law! This company has NOTHING to do with HACIENDA (Tax) or the Spanish Government.
Notary Obligado is based in Estepona on the Costa del Sol, and as per their website the address is Notary Hacienda, 4ª Planta, Oficina 27, 29680 Estepona. So for those not understanding Spanish directions, they actual want to create the impression that their offices are inside the Tax Building in Estepona! This address though does NOT exist; there is not even a street name!
Their contact number is even more worrying; keeping in mind we are talking here to “agents” of official and authorized notaries, well the contact number is a Spanish Mobile 0034- 603395729 although in the telephone conversation one of the callers gave a consumer also a landline 0034 952 600 351

After speaking to the timeshare consumer, they inform they need a payment of 3% tax charge over the money that will be refunded, and this money has to be transferred to a supposed tax agent called Diane Elizabeth Datson (an individual!!) by Western Union /money wire.
Obviously they tell the timeshare consumer the amount due to be paid out to him is suspiciously high to make it more attractive, but of course if they promise for example £43560 to be refunded, the 3% is £1306, not bad for a money transfer on which you CANNOT request a refund as this payment is NOT protected.
Please note that we have to stress once again that there is no money waiting in any Spanish Bank Account for the Government to pay back to timeshare consumers worldwide. Neither would the Spanish Government ever appoint an independent Notary, lawyer or whatever outsource to handle such claims, payments and charges.

I have been contacted by a Mr eric palmer who claims to be ‘the European Notary’, based in Malaga, saying that he has been asked by Official transfer Services (OTS) to make a payment to me for my timeshare points, once I have paid around £1,300 in Spanish taxes, which will be refunded as soon as the transaction has gone through. His phone number is 0034 627 800002. I am convinced this is another scam.
Recieved a call today July 3rd 2012 from Rachel at Notary Obligado claiming to have an offer for me of 17000 euro for my club membership left a contact number 0034603332411
I was sold membership with Club Class Concierge and a Cashback certificate by Terranova in Tenerife in 2008. After realising that I had been scammed I thought my money was lost. Club Class are not as cheap as the salesman had promised, so that was a waste of time too. I would like to inform anyone who has bought a simelar product abroad and paid for it with a credit card (or the deposit) that it is easy to get all your money back! Once the company in question has disappeared (or gone bust) you must simply apply to the credit card company for your money back. They will try to wriggle out of it with an excuse. In my case it was that Terranova was nothing to do with Club Class! Ha! The next step is to contact the Financial Ombudsman and ask them to contact the credit card company. Your money should be returned to you in a matter of days! In my case I had paid the deposit by credi card and the balance by a loan. I was only expecting the deposit back but the FO got me the full amount. This is written in British law, it is your right so don’t take no for an answer. Good luck! Charlie.
