Business Consultancy Services, cold calling resale company from Marbella

beware of phone scamsA new cold caller by the name of Business Consultancy Services is added to our cold caller list.

Business Consultancy Services cold calls timeshare consumers and claim to have a buyer for their timeshare membership.

They are not very “generous” with the company information as there doesn’t seem to be a website at all for Business Consultancy Services and no telephone number is mentioned in the paperwork they send through by email.

At some point in the follow up call they do give out their number for call backs:

The agent calling from Business Consultancy Services is Peter Clifford and the administration person sending the email is Sandra White.

Apart from confirming the resale offer they also explain that in order to complete this sale the timeshare owner needs to pay a “Liability Insurance” of €1395 upfront..

This money will be refunded in 4 to 6 weeks when the sale is completed.

The timeshare owner is assured though that the buyer is also paying a 35% of the purchase price as a deposit.

With above information or lack of information we feel we have more than enough to recommend consumers not dealing with this company and certainly not pay the (illegal) upfront fee!

    I have been contacted by this company today (5/2/13) and the man asked for £1125 as in insurance deposit. This was to show commitment to the sale and not tempt me to sell to someone else for more money. As this would only be taken on a mastercard or visa card, it would be protected by the consumer rights act and money would be recovered by my credit card company if I was deceived or scammed. All sounds very genuine, but then if you don’t have a spare £1125 what are you supposed to do. Surely contract law would cover you and the “proposed buyer” as a verbal contract had been entered into by both parties with BCS.

    I have had the same approach, and when I queried the insurance liability sum required, I was told it was purely because they do not get my actual certificate until the purchase has gone through, when they collect it by courier. The insurance is therefore to protect them if I do not produce the certificate. They also pointed out that as it would be a credit card payment, I would be protected by my credit card company. Any comments?

    • Hi,
      Upfront payment are illegal and are against the Timeshare Directive.
      If they have a buyer and this buyer has paid a deposit or the full sum, they could take the “insurance deposit” from the money they have to pay you, send you the rest and keep this balance until you send the paperwork.
      I’ll bet you they won’t go for that one!

    We have been contacted today (11 Jan 2013) by a lady from Business Consultancy Services, Marbella, as mentioned in your article here. After quite a long phone call with my partner whereby the amount of £1395 was requested, we finally said that we were not interested, at this point she became quite rude and surprised that we would not take this opportunity, even though I said I would be happy to pay that amount after I had received the quoted money, she obviously would not agree to this. The phone call came to an abrupt end at that stage.
