Club Class Group is still asking for annual fees

Last October 2012, The Insolvency Service ordered the wind up all the companies, collectively known as Club Class, as they were all intimately involved in the marketing of the scheme in the UK.

Seven connected companies, which mis-sold membership of a concierge holiday scheme to the public while ostensibly conducting meetings to propose action against timeshare deals, have been wound up in the public interest by the High Court in London.

However, this order has not been an obstacle for Club Class to continue their dubious operations.

We are receiving complaints from consumers contacted by Club Class asking them the annual fee payment.

Who dares to pay an annual fee to a company that was wounded up by the UK Authorities!!!

Dear Club Class Holidays Members

You are receiving this email because your required Club Class Holiday and Lifestyle Club Membership £55/£75 (contract depending) Annual Subscription payment is currently in arrears; and in some cases, may have been for several years.

The Club Class Holiday and Lifestyle Clubs are currently under new administration, and as a result we have been instructed to contact all existing membership holders that have outstanding annual subscription payments and request these arrears are cleared and their memberships activated accordingly.

Please fully understand that the clubs main beneficiary income is gained from the holiday and lifestyle services our members book and the payment of their agreed annual subscriptions and without this financial injection the club will eventually cease much to the detriment of our existing 100,000 plus client base.  

As a Club Class membership holder you should already be aware that the payment of annual subscriptions is a requirement of your contract, having agreed to our membership conditions when you initially joined the club, and as a consequence you are expected to comply to this very important instruction.

Though your individual circumstances may differ, your membership status shows that you currently have subscription arrears having allowed your payments to lapse. Whether or not you believe otherwise, our records show that your membership has simply been suspended and all accrued debt remains in your liability and responsibility to maintain…”

    Pleased be informed that EURAFRIC SL has been appointed as the professional administrator of Club Class and Leisure Alliance membership products.

    Despite previous attempts to notify you of your annual subscription arrears, no payment has been forthcoming and as a consequence of this contractual breach your account is now SERIOUSLY OVERDUE.

    However, in an effort to seek closure in this matter, we are willing to offer you a one-off contract release charge of only £350.

    Upon receipt and clearance of this charge, all annual subscription arrears will be waived and your. Club Class membership will be terminated. You now have a further 21 days to accept this offer and make your payment.

    Should you choose to reject this offer, then we will have no alternative but to commence further action in order to recover the outstanding deficit and any additional applicable charges.

    We trust that you will be accepting our reduced settlement in order to conclude this matter without unnecessary escalation.

    Well, Maxwell Hamilton has obviously been a good boy as he appears to have a new job title – letters I have from him dated 17/12/2014 & 16/04/2015 gives his title as “Club Class Membership Renewals Department Manager” and they also seem to have now moved from the long used “Garrison House, Gibraltar” address to Mijas Costa.

    What is also amusing to note is that their letter dated 16/04/2015 states that if we didn’t communicate with them directly by 30/04/2015, (which we didn’t of course) they would take further action!

    I will of course not be contacting them!!!

      Like yourself I have been receiving emails and letters from EURAFRIC SL over past months to which I did not respond. Two days ago I received a letter with the same wording as yours. I do not have any plans to contact them but am of a mind to notify my solicitor of the harassment I am receiving.

    I,too am fed up with club Class and the attendant sc****** trying to persuade me that they can “help” me to get my money back The latest is a self employed “middle man” (his words) called Peter Allen (Alan?) who hails from Nerja in S Spain. He has a deal to get my money back as long as I give him £1500 “liability Insurance fee” in case the deal does not go through. He has a buyer all ready to take my membership off my hands. I should not worry about laying out the £1500 because my credit card company will reimburse me if the deal doesn’t go through. Oh, and by the way. If I don’t accept this wonderful offer (or buy myself out of my membership with CCC itself, I will probably end up in court for non compliance with .CCC rules!!

    We keep getting phone calls and letters telling us that we owe them money too and to be honest i am fed up of it. We have got nearly all our money back from our credit card company and we have been in touch with the police as well. I don’t need these people keep hassling us as i have ill health and that doesn’t help.

    l have just had a e-mail from clubclass asking for the annual fees of £95 ,are they taking the piss or what ,sick to the teeth with this lot ,l just what to know who we can trust to get our money back without ALL THESE SCAM COMPANIES ,they keep on phoning us

    I too have received emails and letters all as received by others requesting payment, the last being an offer for me to pay £285-00 to get out of the club. i have not responded other than a phone call to Laura Kay who threatend me with legal action stating they would win the case with me having to pay legal costs as they had taken many to court in the past and had never lost a case to date.
    What are the thoughts of others please?

      I have been looking for civil action claims in court by Club Class since I received their latest demands and threats some 18months ago (after a break of about 10 years I may add) and regular web searches have revealed nothing relevant. The only case of interest I found was a holiday club called Petchey who had employed debt collectors called King’s Ransom who had taken the defaulting members to court. Members were apparently refusing to pay because of poor service, lies in the agreement arrangements, etc., etc., sound familiar? The case was by thrown out by Manchester Crown Court and costs were awarded to the members who were being sued.
      Look it up online – the report is dated 16MAR2011 and the defendant’s solicitors were Linder Myers. If anyone does know of a succesful court prosecution of members who refused to pay I would be interested to see it. From my own experience and research Laura Kay (if that is her real name) is quite simply lying. Just like the rest of Club Class.

    Thought all you lovely people would like to know that 2day i received
    my initial credit card co deposit £1845 from my credit card co.
    this was all on the advice of Senor Garcia of Mindtimeshare
    I parted with my money in may 2009 and through credit card section
    75 of the consumer act i finally beat the scam of GBM Great British Marketing.
    it is not easy doing this as you have to do it personally your self ,but if you have enough evidence and paper
    work plus advice from Mindtimeshare it can be achieved.
    also if you are receiving unobtainable phone calls saying they will buy it of you
    please please ,be rude and if answered slam the phone down
    its been 4 long years since i joined GBM/ Club Class Concierge
    so there is hope if you follow all the right and legal path

    Dear Mr & Mrs ****

    We must advise you at this time that we have never received any formal request from yourselves with regard to suspending your Club Class Concierge platinum Indefinite Membership.

    Additionally to date you have an outstanding debt of £95 for unpaid annual subscriptions, having lapsed in July 2012. These arrears must be paid , before our process of cancellation can begin.

    Unlike most timeshare ownerships and other such holiday club schemes; Club Class do offer an opt out clause, however we charge a penalty of £190.

    Therefore a full and final charge of £285 must be paid and upon clearance, your membership will be cancelled and your personal data removed. If alternatively you wish to continue your membership or to attempt to sell it, you are only required to pay your £95 arrears. Please make this payment by using one of the methods enclosed within this correspondence.

    We must insist that you contact us urgently, if you have any queries regarding this matter, wish to make payment or may be interested in reselling via our internal referral program

    I telephoned the 0870 number and spoke to “Laura Kay” advising her that under no circumstances would I be sending ANY money to a company that was declared insolvent last year.
    She tried to make out that Club Class were not insolvent and were still trading. I again advised that I would not be making any payments and if they wanted an money from me they would need to take me to court. I in turn would be contacting the UK Insolvency Service detailing what they were doing.
    I also advised that I had never been able to use my membership and why would I want to pay additional money to the company that had previously sca**** my wife and I. She had the cheek to say that CCC had not received ANY money from me as the £5000 we paid was kept by the ” selling agent”!!!! I advised her not to treat me as an idiot and reiterated that I would not be paying any further money and hung up.

    Do you have any advice on anything else I need to do?

      Took Albertos advice from his direct reply to me and contacted:
      Official receiver uk insolvency service – had a very quick response and have supplied additional information they requested
      OFT – no response yet.
      Local Trading Stds – no response yet

        Got a call today from ‘Laura’ @ Club Class – still trying to con me out of membership money!! This time however they are calling from a new tel no. 0208 1669852 – I didn’t even start a conversation, but put the phone down – 3rd letter now expected!!

    I am not only getting these emails but this week I am being hassled by phone calls. I have just told told them that as I am currently in dispute with them I do not wish to make any comment and I have put the phone down, They have tried to get hold of me today for the 3rd time in one week. Will it be the heavy mob calling at my door next? I’m quite worried now.

    One thing that intrigues me is how come Sochalls are still accepting payments to a company they must know has become insolvent ? Does that say anything about Sochalls ? I am merely musing on thoughts in my head – in no way do these questions cast aspersions on the trustworthiness of of Sochalls. I am sure they must be an honourable company.

      By Sochalls acting as the British collecting agent for an insolvent company, are they knowingly breaking the law.?, as i thought it was illegal for a company to continue trading while insolvent,and here Sochalls are collecting money on behalf of Club Class.

    I have just received another email from them about my lapsed fees. This time it tells me how I can go about cancelling my membership! First I’ve heard about having to pay more to get out of something like this.
    If you have any outstanding annual subscriptions, they must also be paid up-to-date before any request to cancel will be acknowledged.

    To sever your indefinite Club Class contract, you must pay an early termination penalty which equates to 3 years annual subscriptions.

    To comply with data protection laws, in order to complete this cancellation and therefore no longer receive any further communication from Club Class, your cancellation request must be performed in writing and posted to our Gibraltar address, and include a copy of an official form of identification for each contracted membership holder. If deceased or divorced, a copy of the an authenticated certification will be necessary.

      Thought we were the only ones who had told Laura Kay she was ‘working’ for a dissolved company – no wonder she she was able to answer a question before it was asked. Our letter says that on receipt of the two years annual subs plus a £75.00 early termination penalty that once the cheque has been cleared that our membership will be cancelled and all personal data removed. There are two tel nos 08702247994 and 0034952922555. Their title is The Club Class Holiday and Lifestyle Club – administered by Leisure Alliance Plc. According to Companies House Register Leisure Alliance Ltd was dissolved.

    We still get requests from Pro travel solutions asking for the yearly subscription due to DWVC and even had an offer from them to pay 2 years and then they would leave us alone. We also get regular emails from them headed “Holiday Offers from DWVC”. However not had any cold calls recently offering to sell our DWVC membership. I think the time we signed up for is now past so we have nothing to sell on( but I don’t suppose that would stop them). Our cashback claim was rejected as it arrived 1 day too early. Not bad for the post office and Spanish post system to manage such an unlucky delivery.

    As ihsd received the e mail you highlight, I replied to the e mail as suggested and fowarded it to The Insolvency Service. Clubclass have replied to both me and The Indolvency Service, stating that they are bemused at my reply and that they are not subject to such action.
