Lately there seems to be a lot of criticism about Mindtimeshare for not reporting any irregularities committed by certain timeshare companies. Specifically, I am criticized for not denouncing Anfi del Mar or Resort Properties.
I would like to provide all our followers with my view on this matter and clarify some doubts people might have regarding these issues.
1. – The objects of Mindtimeshare are allegedly fraudulent companies.
What kind of company would Mindtimeshare consider to be fraudulent? Companies that usually do not have any inventory back up. Companies whose staff is not compliant, and usually their work contracts are not registered which means they are not signed up on social security either. These Companies usually do not pay their taxes. They do not have the slightest structure or substance. Companies in which substantially all of its customers can be considered victims. And most worrying, these Companies have an expiration date, as they disappear when they are caught up by Justice.
If we analyze the companies that are mainly mentioned in this criticism: Anfi del Mar and Resort Properties, we see 2 companies that for a start are employing at least over a thousand employees. Between these two companies there are over 1500 apartments owned, which provide holidays year after year to over 50,000 families.
Companies in which the level of customer satisfaction is usually acceptable, or even high.
Companies that have been around for almost 30 years. Companies that have been accepted as members of prestigious institutions and are or have been members of business associations both locally and globally.
Neither Anfi Del Mar or Resort Properties, or any other similar timeshare company, are part of the objective of Mindtimeshare.
2. – If a timeshare owner from Anfi or Resort Properties or any other timeshare company has a problem with his membership, the first thing to do is contact the Customer Services Department of the relevant company. Anfi, for example, has more than 15 people in this department at the member’s disposal.
If the Customer Services department of the firm does not solve the problem, then you can go to TATOC and / or RDO.

These are the types of problems that must be solved TATOC and RDO. These organizations are there to serve as an intermediary between the consumer and the company where they own their timeshare membership.
The objective from TATOC and RDO is actually to solve problems. And both organizations have set up a strict ethical code, a code of conduct by which affiliated companies have to act.
3. – However, if through the above departments / organizations you feel you haven’t solved your problem and think it should be taken further, then do it. I would suggest you go to an independent Trading Standard Office or if you want to take your claim even further then start legal proceedings if they are considered appropriate.
Please be warned though and be very careful with who you hire for these legal proceedings.
Be wary of companies like Reclaimgc, Timeshare Refund Network, Canarian Legal Alliance, MM Consultancy, etc … (yes, yes, the same who criticize Mindtimeshare, because we are denouncing them and warning consumers to be careful. See all links below)
4. – The Court Ruling against Anfi.
These above mentioned companies or similar will ask for approximately 8.000 pounds sterling in exchange for participating in the legal cases, with the added risk of having to pay court charges if the Court does not Rule in favor of the customer.
Let’s face it and not let a single branch prevent you from seeing the entire forest.
The people in charge at Reclaimgc / TRN report having more than 1000 cases of timeshare owners which are taken to the Spanish courts.
To me this sounds as too many cases, especially when the managers and directors of these companies routinely cheat to achieve their goals.
Also, if you claim to have over 1000 cases at 8000 pounds each, they have received 8,000,000 pounds in less than two years …. That is a lot of money!
How much tax revenue has this supposed income generated?
What we do know for sure and can be shown publicly, is the systematic loss of dozens of lawsuits in the courts of first and second instance.
Why do Reclaimgc & TRN not advertise the dozens of cases dismissed by judges and only give publicity about the three positive judgments at first instance and in the second sentence?
Why not say that this latest sentence, won on appeal by lawyers for Reclaimgc, lacks the minimum legal rigor (personal assessment), and does not dwell on the main problem and the Lawyers from Anfi have appealed to a higher court?
5. – The reason for a Demand.
What is the main reason, the cause, which with Reclaimgc / TRN convince the Anfi owners and tell them that a court judgment will return all monies paid for their membership? (We have to remind here that the ways in which Reclaimgc contacts their victims is through cold call and through illegal street OPCs)
Reclaimgc tells all the Timeshare owners from Anfi that they are entitled to a refund as Anfi did not comply with the European Directive and took deposits during the Cooling Off period.
So why are the judges filing the majority of these claims? Well there is a clear explanation to that. The Spanish law allowed a third party to take deposits during the cooling off period. In the case of Anfi these deposits went into a Trustee Bank Account.
And in all those years we have not found any Anfi client who was refused the refund of the deposit in the event of withdrawal / cancellation of his contract during the Cooling Off period.
So why would Reclaimgc / TRN continue their activities? Well that is more than obvious I think, because they charge around 8000 GBP for each case!
Can a lawyer keep on accepting clients with the same argument when they see a Judge is systematically ignoring their requests? Would the code of ethics of a lawyer allow them to do this? Hence the office of Mr. Carlos Kaehler, a lawyer working for Reclaimgc from the very beginning, has disappeared from the scene.
Reclaimgc are now using lawyers named Rodriguez Ceballos and others that can be seen in different Mindtimeshare links. But for how long? Well until they feel the same pressure from the Bar Association of Las Palmas, which Mr. Kaehler also experienced.
The issue is not trivial. The business license of the lawyer is at stake.
6. – The criticism against Mindtimeshare comes from the criminals themselves. We actually counted on that and we accept this “as part of the game”. We couldn’t expect less from these offenders.
Of course they do not want to lose the income they are getting illegally through the poor victims; the timeshare owners.
What does angers us is that other “actors” also appear on stage, who in theory fight for justified causes, who cannot be considered criminals but are giving credibility to the arguments of the real offenders, echoing and providing publicity to the bad criticism.
I cannot understand that these “actors” who in theory fight for just causes, take this as a personal crusade against the timeshare industry and raze against everything and everyone, without stopping to think about the consequences.
Mindtimeshare is torpedoing the waterline of fraudulent companies. Mindtimeshare’s efficiency and effectiveness in our daily work will even be more and better in this year 2013.
But what is significant here is not that criminals are making less money with their scams, but, thanks to our efforts, we have increasingly fewer victims and fewer timeshare owners are being cheated.
With our work we contribute our bit to enhance the prestige of an industry, which we believe, that has been badly tarnished by fraud.
We will continue to fight against fraud. And maybe even with much more reason. Because our greatest reward is the one we get from consumers when they thank us, because by reading our blog they have refrained from doing business with a fraudulent company and avoided being cheated.
