Who has received the “new” version of the fees request letter from Club Class?


Club ClassYes indeed there is a new version of the letter that Club Class mails out to their members requesting outstanding fees.

They have been mailing all customers actually they have on their database; Club Class Members who cancelled years ago and even those who never paid in full for the membership!

The article we posted on here http://wp.me/p1kmoi-MF a couple of months ago generated numerous complaints.

Now we received the latest version of a letter that has been send again to the members or supposed members.

In this letter they remind the consumer once again that he has outstanding fees from years and years. Most of these adding up to hundreds of Pounds.

Instead of threatening with legal action as they did in previous occasions, they now go the route of “being nice”

“Unlike most timeshare ownership and other such holiday club schemes: who may

seek court action to obtain any outstanding maintenance or membership fees, Club

Class do offer an opt out clause, however we charge a penalty of €220…”

So apparently after they failed to intimidate consumers into paying the fees with their other letters, emails and tiring phone calls, they now come up with an “opt out clause” which more less means that for €220 plus the supposed outstanding fees (!)  they will leave you alone and stop harassing you for something you do not have to pay in the first place!

We recommend all Club Class Members or non-members who receive such a request to go through their paperwork and check the clauses on the actual fees. There might be different versions of the clauses in the agreements as sales were done by different marketers. But in most of the agreements it clearly states that failure of non-payment of the fees will result in de-activation of the membership. There is NO MENTION of an obligation to pay.

For those who bought into a Club Class Membership after the new Timeshare Directive came in place, in February 2011 there is another point to add. Most agreements signed are for 12 months only, a clever way to avoid this Directive which stipulates a 14 cooling off for memberships with duration over 12 months. The new members did not receive this cooling off.  So how comes now that the fees after 12 months are an obligation? Is Club Class telling you the membership wasn’t for 12 months in the end?

    I keep getting emails and phone calls, supposedly from Club Class, stating i owe £95. The sales rep even had the nerve to claim he spoke to my daughter last year reference my membership, not sure how he could do that considering i don’t have a daughter! He also couldn’t tell me why i didn’t get my £6000, from the cashback scheme i was enrolled on, when i attempted to claim it! Unfortunately i purchased this waste of money in 2007 so can’t get money back from C/C, gutted. Think next time they call i may unload on the foreign salesman although I’ve told them to contact me purely by email.

      Have you just missed out on the 6 years to claim back 2007- 2013?.

        Yes by a few months. Had another email today from Justin Gilson (Membership Renewals and Customer Relations Manager) telling me that they are trying to get my contract from storage in Gibraltar as well as stating ‘can we please ask you make this payment as soon as possible so that we can rectify this problem, prevent this problem from unnecessarily escalating’ (sounds a bit threatening).

        How are they able to do this if the companies in liquidation, surely all communication should have stopped. Not sure but can any agreement with club class be passed on to another company?

        Justin Gilson is in my opinion a bit useless, like a politician, can’t answer a question. my £95 was due in may and I have no intention of paying. My timeshare was with Atlas and the paperwork was never sent to them by ccc, although ccc said Atlas would not accept it and I was getting hounded by Atlas, Justin Gilson said just to ignore it so I am turning the tables and I am ignoring their demands . They owe me big time and I have told them to deduct the money and send me the change . I paid the £95 for 3 years whilst waiting for the “cash back” which I never expected would come, so was not really surprised when it didn’t. So my motto is “NO MORE”.

        Russ. Just ignore them. That’s what I am doing. In my opinion and experience Justin Gilson is a bully. In the original insolvency decision against Club Class a Dennis Gilson (would be surprised if it’s not some connection or even him) stated on CC behalf that the Cashback scheme was akin to ‘Spot the Ball’. To me that says it all about Club Class

    Had a call from Club Class saying I owed £95.00 for my outstanding subscriptions, and to cancel I had to pay £285.00 penalty charge making a total of £380.00 I don’t think so !!!!! Just got a letter from them saying the same thing .

      Since my last posting August 3 2013 I have had another phone call about my outstanding subscriptions, which got a little bit heated, which I was told if I don’t pay things would get whose. Got a letter today saying , to pay immediately to avoid intervention of a debt recovery, ” Which will considerably worsen your current predicament ” it said in the letter. Anyone else had the same sort of correspondents??

    we have had loads of e-mails from club class asking for the £95,had a phone call the other day asking for it to and l said couldn’t afford to pay it and she was quiet surprised and said she would leave it a week or so how l could get the money of family,l said l though it had gone liquidation and she said that leisure alliance was running it now.if l wished to cancel my membership l would still have to pay the £95 plus£285 , never used the thing and never will but what can l do ,cant get money back from visa card cause bought it in 2006, l got her to send me a letter stating everything that was said on phone ,now l have a copy,please help !!!

      Whatever you do, do not pay this money then at least we are all in the same boat, I have had the phone calls, emails, letters and I have told them to take it out of the money they cheated us out of and then they could send the change! .If nobody pays the fees they would soon all be out of a job and ccc will be gone once and for all. Alberto will reply to you guiding you with his expertise.

    I have also had 1 letter, 2 emails and ” the phone call ” requesting the £95 fee and if I wanted to cancel it would be plus another £285, I told the lady to take it out of the Cashback Europe payment they owed me!, then she asked if I had tried selling it through them for a fee of £55, I said “I wouldn’t give you .55p”. I told her they had conned and cheated enough out of us and I had got my deposit back from my c/c company for a “gross misrepresentation “of a product, I think she got the message I was annoyed and would not be paying any money so she then suggested I ring customer services to see if they would reduce the £285 fee !! how thick are some people?

    We have also received a demand for arrears by letter. They want £380 to clear the arrears. It is from a Maxwell Hamilton but not signed. He is membership of Department Manager. The Club Class Holiday and Lifestyle Club Administered by Leisure Alliance Plc. We have a Platinum Indefinite Membership. We were paid up till Jan 2013

      We have received a similar letter from Maxwell Hamilton telling us we can pay a full and final charge of £380 when our membership will be cancelled and our personal data removed, but why would we pay them any money at all when we are lead to believe that Club Class have been closed down???

    Club Class are still looking for annual membership of £95 although we were told it was only for one year when we took it out. We have never used them and will not be stupid enough to use them in the future.

    I have also received a demand for £95. Guess what -they won’t be getting it!
    On a positive note I recently received a full refund plus 8% from my credit card company over the Mis-selling of platinum membership by CDS Concierge on behalf of Club Class. I first claimed to MBNA in September 2010. They rejected my claim and subsequent appeal. I then took my claim to the Financial Services Authority who also rejected my claim. I then appealed to the Ombudsman who upheld my claim on the grounds that CDS Concierge misrepresented the inducements and the product. I received the money a few weeks ago but not before MBNA missed the deadline for payment. The 8% was backdated to Sept 2010.
    Perseverance and natural justice produced eventual success.

    i have just recieved an email from club class for £95, i would`nt mind but i got my money back through my credit card 12 months ago (so let them take me to court)

      l keep getting e-mails from club class wanting the fees of £95 and JUST HAD A CALL FROM A COMPANY CALLED SUNSET SALES ,asking me if l wish to sell my club class membership,l said how can you sell them to people if the company has gone into liquidation and he said ONLY PART of the company has gone ???? . we keep getting calls from timeshare refund network too ,saying they can get our money back for us ,abit worried ,can’t wait till they ALL stop ,cause we want our money back from all these ccompanies but WHOdo you trust !!!

    I have had a green and a amber warning from clubclass demanding a £95 membership renewal fee, also telephone calls from a Magarita Sak, I asked her who she was but she wouldn’t say what company she worked for, just another scam from clubclass /clubclass2/LA Premier take your pick I don’t think they now who they are cos they have changed their name so many times

      I have received a yellow warning letter from Club Class saying that I owe them £95.00 for my annual subscription ;also they say it is a requirement of my contract to pay when I ( was conned )into signing the contract originally.
      Don`t they understand that they broke the contract, one of the conditions being that they would take over the maintenance payments , which they have not done , so I am lumbered with having to pay monthly to catch up on my maintenance arrears on my Timeshare , when replacement papers will be re issued to me for ownership, when I have caught up,as Club Class have never forwarded them to Interval International.
      So if they want £95.00 from me they can start taking it from the £5000 they conned out of me!
