ITRA, the International Timeshare Refund Action seems to be “innovating” again. This time it is yet another additional service offered to those Timeshare Owners who attend their meeting thinking they are going to be informed about a No Win No Fee Class Action.
Timeshare Owners invited through companies such as Cancel Our Timeshare, Multi Claims, Purple Tower Solutions, etc. are indeed informed about the class action, but as mentioned in other blog articles this is not the real “money maker” for ITRA.
The additional products or services offered seem to be so much more important for ITRA.
If before they would convince Timeshare Consumers that the only way out was to change into a Club Class Membership, in the past year this has changed into a Disposal Service which was pitched to the Timeshare Owners as the only way out of the perpetuity clause.
Now they have come up with another additional service. A refund claim through the Credit Card Company under the Consumer Credit Act.
Yes, ITRA is now also offering to do this claim on behalf of the Timeshare Owner. A claim which will be done on a No Win No Fee basis, although an initial payment of £500 is requested.(?!) Once the claim has been successful the Timeshare Owner will have to pay a 40% over the awarded money.
Obviously No Win No Fee does not mean No Payment upfront for ITRA.
The documentation they present to the Timeshare Owners who want to take up this service, contain an authorization document to be signed by the customer. This documents states that the customer authorizes ITRA to be their representative and claim on their behalf and also receive paperwork on their behalf.
But that is not all! It also states:
“Should compensation be payable, I authorise same to be sent to the Chartered Accountants representing ITRA, i.e. Messrs Sochalls LLP whose address is at 9 Wimpole Street, London W1G 9SR, UK and whose bank account is as follows…..”
So ITRA would receive the full amount awarded for the claim! Not the Timeshare Owner but ITRA! And again using an account with Sochalls.
And how will they get customers through the doors? Are they going to use their client database from previous meetings? Are they going to contact those who took on the disposal service and are still waiting for this to happen and will now convince them they are better off claiming through the credit card company? And what about all those who bought into Club Class, are they going to offer them this service?
Mind you the consumers who want to claim a refund of what they paid to Club Class will be easy customers for this new service of ITRA. Because as you need to proof mis representation and / or breach of contract, ITRA certainly has the “know how” of what happened at point of purchase. They were there!
Surely ITRA can provide the credit card company of the Club Class Members with all the proof of mis representation, the breach of contract because the timeshare was never transferred out of their name and the “guaranteed” Cash Back that was never paid out…
Please be very cautious with the services of this company that is all we can say!
