Cold calling company Agencia Viajar seems to be rather busy lately. This company that pretends to be a Travel Agent / Timeshare Resale Company is actively cold calling timeshare owners of all kinds of resorts.
On the first call they explain how the business has changed nowadays and apart from selling holiday packages they are also selling existing Timeshare weeks.
Not surprising at all they even have a buyer lined up for the Timeshare of the owner who is cold called.
Agencia Viajar pretends to give a serious business impression, and they confirm the resale offer with all kinds of official looking paperwork and sample agreements.
It becomes very soon clear though that they don’t seem to have heard about the Timeshare Directive at all, and even worse they seem to have invented their own laws.
One of the clauses in their agreement states: “Once the seller has received the full purchase Contract together with a Receipt for the full purchase price paid to the Beneficiary, he is then committed, in accordance with Section 4 of the Directive, and is required to deposit their Contract Deposit for the sum of 3.340 Euro (10%) to the nominated Trustee within 2 working days. This deposit will be refunded should neither party execute their right of cancellation.”
So, to clarify, once Agencia Viajar tells the Timeshare Owner that the buyer has deposited the purchase amount in their accounts, the seller needs to pay this 10% fee over this amount.. Refundable….Of Course!

They also mention a website www.viajar.com which is a generic website and search engine for all kinds of holidays, NOTHING to do with Timeshare resales and certainly not with this bogus company Agencia Viajar.
