This company T.S.M., which seems to be based in the Avenida Ricardo Sorreano 24, in Marbella on the Costa del Sol, has no problem with promising the timeshare owner a guaranteed resale.
In their documentation they even state that the maximum resale time will be 3 months.
That is not the only statement they make, they also claim to be registered in both Spain and Gibraltar and T.S.M guarantees 100% the resale will take place and with complete refunds.
The word refund does make alarm bells ring, because if you are selling, what “refund” is there to make?
But indeed there is another issue to be mentioned which is the UPFRONT payment to get the sale done through this company.
They kindly call it a “registration fee” and the amount is €1200 payable through bank transfer into an account from an individual.
As explained in the documents they send to the consumers, the registration payment stands for: – publication of the time-share object – registration for time-resale. Administration and commission fees - verification and research of the time-share – transfer of certificate names - all trust fund transactions.
It does appear though that this company has no knowledge of the European legislation, which clearly stipulates that it is completely forbidden for a resale company to ask for upfront fees from the seller to process a sale.
This apparent ignorance of the legislation added to the fact the company cold calls, and their paperwork is filled with writing mistakes even in their own address, does not really make the company Time-Share Stockmarket look very trustworthy.
