Experience has taught us that a lot of companies start being active again as from January on wards, so please be extra careful with those dubious cold calls you receive.

It isn’t only about resale of timeshare nowadays and the pitches range from Disposal services to Legal assistance, claim companies and even Tax offices or Notaries.

Never trust a cold caller and if you are approached by a company with offers regarding your timeshare, please do your research and double check with us.

CLA Marketing is connected to another well-known Company: Canarian Legal Alliance SL

CLA Marketing SLwww.cla-marketing.com – and Canarian Legal Alliance SLwww.canarianlegalalliance.com – are both linked to the plot of alleged criminal suspects arrested last July 2013 by the police in the south of Gran Canaria, and  related to the Voyager Travel and Lifestyle Holidays set up.

Behind CLA Marketing is the company CLA Marketing SL, registered in Las Palmas in August 2013, only days after the police arrested the gang of alleged fraudsters in the Operation Voyager.

The Spanish Companies House shows that from the 28th of August 2013 CLA Marketing SL has a partnership with surprisingly another known company by the name of Canarian Legal Alliance SL.

As an associate of Canarian Legal Alliance SL appears Paula Beatson, a British citizen who was detained by police in Arguineguin in July 2013, as part of the Operation Voyager and charged by the court for alleged fraud and criminal association.

From the same date 28/08/2013, the same Spanish Mercantile Registry indicates that an individual by the name of Stephen DOYLE is the sole director of CLA Marketing SL.

Stephen DOYLE… That name certainly rings a bell!

Since September of 2012, Stephen DOYLE appears as the Director of another companies belonging to this gang of suspects, namely Timeshare Refund Network. A company about which we published an article as well on the Mindtimeshare blog.

Como socia de Canarian Legal Alliance SL aparece la británica Paula Beatson, detenida por la policía en Arguineguín en Julio de 2013, en la trama de la Operación Voyager, e imputada por el Juez por presuntos delitos de estafa y Asociación Criminal.

Desde esa misma fecha de 28/08/2013, el mismo Registro Mercantil Español informa que un individuo con el nombre de Stephen DOYLE es el Administrador Único de CLA Marketing SL.

Stephen DOYLE…. ¡Nos suena tanto este nombre!

Not always our warnings are for cold callers or dubious Holiday clubs that pick up their customers from the streets with fake promises…

This time we want to warn about a website www.timeshareresaleuk.com which has been detected through continues research on the internet as a prevention task.

On the website they assure they are the best Timeshare resellers and the only ones around that can provide guaranteed solutions to your Timeshare resale.

All you need to do is fill in a contact form with all your personal details so they can contact you for more information.

But before you start typing in all your personal details, please do have a thought about the following; who are these people from Timeshare Resale UK? Where are they based? Are they a registered company? What are their contact details?

None of the above details are actually available on their website!

So are you willing to take the risk of providing your personal details to a company that does not even provide you with their basic information?

What would you do if something goes wrong, where would you claim?

Promising guaranteed resales is quiet over the top on itself, but putting yourself in the hands of people that don’t bother to provide you with proper company info, is running an unnecessary risk!

You never know where your personal details will end up…

Have you been contacted by Hockliffe Solicitors?

A new dubious cold caller has been spotted by the name of Hockliffe Solicitors.

Timeshare owners have been contacted by a lady called Christina Delgado who claims to be working at a Notary office, Hockliffe Solicitors.

She explains to the Timeshare owner that they have free weeks accumulated from the Timeshare but their Timeshare Company has actually transferred these weeks to another company. As this hasn’t been done properly the Timeshare Owner is entitled to a compensation of around £7000

In order to claim this money they need to pay Spanish Taxes of around £1500 and this can be done by filling in a MODELO214 form and this has to be done before the end of the year.

Hockliffe Solicitors even sends off an official looking document to the Timeshare Owner, with the logo of the Spanish Tax offices and a breakdown of the taxes to be paid.

These taxes can be paid by bank transfer in the name of Sarah Jane Hockliffe.

Research has shown that there is no such Notary office by the name of Hockliffe Solicitors in the entire Spain and the story they tell the Timeshare owner is unlikely to be true.

It does appear though that Hockliffe Solicitors and Ms Christina Delgado are targeting mainly elderly people.

Have you heard from Thomas Locke Liquidation Services of Surrey?

A new cold caller, this time from Cheam Surrey and by the name of Thomas Locke Liquidation Services.

They cold call Timeshare consumers to advise them about the liquidation of their Holiday Company and money waiting to be paid out to the victims.

Thomas Locke knows all about the consumer, including all the amounts paid for the membership in the Holiday Club, dates of the agreement and personal details. Scary!

A man called Daniel Gates will get in contact with the Holiday Membership owner after this initial call to arrange for the money to be transferred to the owners account. There is no charge for this as Thomas Locke already made money from the liquidation itself.

The address given for Thomas Locke Liquidations Services is 637 London Road, Cheam, Surrey and a telephone number of 0845 862 1429

Indeed Daniel Gates contacts the owner the next day and explains that yes the money is waiting for them but first Spanish Taxes need to be paid…

He explains the Owner needs to go to the Tax offices in Spain and arrange to get this sorted apart from the fact the paperwork will need to be translated.

However, there was an alternative measure the owner could take to avoid an unplanned  trip to Spain and that is to send the money to the Trust Administrators. This is a different company called Bayliss Associates.  This money is to be sent direct by cheque or bank transfer or electronically.

Mr. Gates stresses that the tax needs to be paid by a certain date, so decisions have to be made in a hurry.

Money can be paid into a Halifax bank account under the name of M J Bayliss. Sort code is 11 – 03 – 75 , account number is 01646207

Please note that research has shown that the above mentioned companies are connected to other dubious companies that have been active in the past.

There is no liquidation of a Timeshare or Holiday Club in Spain where money has been set aside to be paid out, and neither would the tax have to be paid upfront as this would be deducted from the amount.

CLA-Solutions, der neue Firmenname unter der gleichen Firmengruppe, mit den gleichen Personen, die bereits wegen Betrug und krimineller Vereinigung angezeigt wurden

Ein weiterer Name muss der langen Liste con Firmen zugefügt werden, die alle die gleiche Verbindung zu mutmasslichen Betrügern haben. Diesmal heisst sie CLA Solutions.

Die Lizenz der Webseite http://www.cla-solutions.com  wurde gerade erst im November registriert und bis jetzt existiert noch kein Internetauftritt.

Allerdings wirbt die Firma per lokaler Radiowerbung und bietet Ihren Service Timeshare-Besitzern an.  Bei diesem Service handelt es sich darum, Timeshare-Besitzern dabei behilflich zu sein, ihre Timeshare-Wochen “loszuwerden” und das bei einer kompletten Rückerstattung aller über die Jahre hinweg gezahlten Geldsummen.

Wie in der Radiowerbung zu hören ist, handele es sich dabei um bisher unbekannt hohe Chancen sofort die Zahlung der Wartungsgebühren einstellen zu können und man könne sogar damit rechnen, auch über Jahrzehnte gezahlte Gebühren zurück zu erhalten. Möglich sei dies alles durch die Zusammenarbeit mit einem Team hochspezialisierter Anwälte.

Für diejenigen, die mit dieser Firmengruppe nicht vertraut sind, lesen sie bitte die folgende Information.

Die Firma CLA oder auch Canarian Legal Alliance ist bereits seit einiger Zeit tätig und hat Ihre Aktivität  begonnen, nachdem andere Firmen der Gruppe ihre Aktivitäten “eingestellt” haben. Unter diesen wären zu erwähnen Reclaimgc, Timeshare Refund Network, MM Consultancy, Blue Flag Solutions etc.

Es ist auch noch nicht sehr lange her, als eine andere neue Firma unter dem Namen  CLA Marketing begann zu operieren, unter der Webseite http://cla-marketing.com/  .  Auf dieser Webseite ist klar erkennbar, dass dies nur ein weiterer neuer Name für die Firma Canarian Legal Alliance ist.

Diese Wechsel von Firmennamen stimmen erstaunlicherweise überein mit dem Datum der Polizei-Aktion im Juli 2013 gegen die Firma Voyager Travel / Lifestyle Holidays in Gran Canaria, bei der 74 Personen verhaftet wurden, von denen 7 des Betruges und der kriminellen Vereinigung angeklagt wurden.

Nicht nur der Hintergrund all dieser Firmen ist äusserst fraglich, sondern vor allem die Art und Weise, wie sie an die Kunden herantreten. Es ist Tatsache, dass es im Spanischen Gesetz nicht erlaubt ist, Konsumenten aktiv zu einem Rechsstreit aufzufordern. Alle diese genannten Firmen tun genau das, bis jetzt, indem sie ungeauffordert telefonisch Konsumenten kontaktieren.

CLA-Solutions the latest brand from the Group of Companies headed by the same people who was charged with fraud and criminal association.

Another name to be added to the long list of companies which are all connected to alleged scammers. This time it is CLA Solutions.

A website domain http://www.cla-solutions.com  was registered recently in November and no website has been set up as yet.

But they do have a radio advertisement where they offer their services to Timeshare owners. These services are relinquishment of their Timeshare Ownership and also recovery of money paid to the Timeshare Company in the past years.

As per the radio add, there are new possibilities to recover their money, something that wasn’t possible up till now and the “expert” lawyers from CLA Solutions can help the victims of Timeshare with this and recuperate their money “immediately”..

CLA Solutions is linked to CLA Marketing and Canarian Legal Alliance.

For those not familiar with this Group of companies we have to point out the following information.

The company CLA or Canarian Legal Alliance has been around for some time now and they started after other companies of the same group “ceased” their activities. Among those were Reclaimgc, Timeshare Refund Network, MM Consultancy, Blue Flag Solutions, etc.

Not so long ago another brand was launched as well under the name of CLA Marketing with a website http://cla-marketing.com/ On this website it is clear that this is another brand name of Canarian Legal Alliance.

These change of companies also coincided with the police arrests in July 2013 against the company Voyager Travel / Lifestyle Holidays in Gran Canaria.

In this operation 74 people were arrested of which 7 have been accused of alleged fraud and criminal association.

It is not only the background of all these companies that is to be questioned but also the way they capture their customers. It is a fact that under the Spanish law it is not allowed to actively incite to litigation. All the above mentioned companies have been doing this through Cold Calls.

Wurden Sie von Malaga Real Estate kontaktiert, um ihr Ferienwohnrecht bzw. Timeshare zu verkaufen?

Mit Malaga Real Estate erscheint eine weitere sogenannte „Wiederverkaufs-Firma“ auf dem scheinbar unendlichen Markt von zwielichtigen Firmen, die ohne Aufforderung Konsumenten kontaktiert und vorgibt, bereits einen Käufer zu  haben, der nur darauf wartet ihr Ferienwohnrecht oder Timeshare zukaufen.

Zur Zeit kontaktiert Malaga Real Estate in erster Linie Deutschsprachige Timeshare-Besitzer, aber es ist gut möglich, dass dies bald auch auf andere Nationalitäten ausgedehnt wird.

Auf die Frage, wie sie zu den Kontaktdaten des Timeshare-Besitzers gelangt seien, wird behauptet, diese über die Schutz- und Regulierungsbehörde oder auch “Servicio al Cliente de la Multipropiedad” in Madrid erhalten zu haben. Um das zu verifizieren, könne der Timeshare-Besitzer die Telefon-Nr. +34 911237247 anrufen. Diese Behörde existiert natürlich nicht.

Darüberhinaus ist das Datenschutzgesetz in Spanien wesentlich strenger ausgelegt als in anderen europäischen Ländern, und es ist deshalb absolut undenkbar, dass ein öffentliches Register von Timeshare-Besitzern, wie von Malaga Real Estate beschrieben, existiert.

Nach dem ersten Anruf (natürlich unaufgefordert) sendet Malaga Real Estate die Kopie eines Verkaufsvertrages an den Timeshare-Besitzer, auf dem sogar die Daten eines angeblichen Käufers enthalten sind, sowie eine „beglaubigte Übersetzung“ der „Richtlinien und Ablauf für den Verkauf von Ferienwohnrechten“, mit einem Stempel der angeblichen Schutz- und Regulierungsbehörde versehen.  Das ganze soll nach einem offiziellen Dokument aussehen, um beim Kunden Vertrauen zu erwecken.

Im Vertrag wird dann erwähnt, dass sowohl der Käufer, als auch der Verkäufer eine bestimme Summe als „Vertragssicherheit“ hinterlegen müssen, die per Gesetz festgelegt sei, und die angeblich auf einem Treuhänderkonto verwaltet würde. Offensichtlich geht die Kenntnis von Malaga Real Estate über das Timeshare-Gesetz nicht sehr weit, denn sonst wüssten sie, dass es per Gesetz verboten ist, bei Wiederverkauf von Timeshare Vorauszahlungen zu verlangen.

Has Malaga Real Estate contacted you for a resale of your Timeshare?

Malaga Real Estate is one of the latest cold callers, who claim to be doing timeshare resales and even have clients waiting.

At the moment Malaga Real Estate is mainly targeting German speaking Timeshare owners but they might expand this to other nationalities.

At the question on how they obtained the personal details of the Timeshare Owner they got access to through the “servicio al cliente de la multipropiedad” based in Madrid. If the timeshare owner wants to verify this is true they even supply a telephone number +34 911237247 to do so.

After the initial (cold call) Malaga Real Estate sends a copy of the resale agreement to the Timeshare Owner with even the details of the supposed buyers.

In this agreement they mention that both buyer and seller need to pay a security deposit as established by law. Apparently Malaga Real Estate does not have any knowledge of the Timeshare Directive, the law that forbids the upfront payments for a timeshare resale!

There is no website for Malaga Real Estate, but their contact details as on their paperwork is as follows:

Please note that we have done research on this company and we can confirm that there is no such company registered in Spain and neither at the given address.

A new cold calling Timeshare resale company has been brought to our attention by the name of Absolute Sales & Marketing.

This company which contacts Timeshare owners out of the blue claims to have buyers lined up for their timeshare. In order to complete the sale they do require an upfront security payment of 1500€

The website www.absolutesalesandmarketing.com was registered in November 2013, but seems to have testimonials from people who dealt with them in February 2013 already.

There is no real company identification on this web, company registration or any other details of this company.

Vallejo del Potro, the FAKE lawyers from Madrid.

Yet again a new cold caller that pretends to be from a Lawyer’s office, this time Vallejo del Potro supposedly based in Madrid, Spain.

Mr. Jos Dercks who works for this law firm Vallejo del Potro explains to the Timeshare owner that they can claim back money through the court, and as a matter of fact there is an upcoming case against their Holiday Company and they can join in.

All the consumer needs to do is pay a 10% fee or costs over the awarded amount once the case has been settled.

In no time the consumer is contacted again and Mr. Dercks even sends through the official paperwork with the consumers name on it and where the court confirms money has been set aside to be paid out.

Amounts around the 20.000 euros are mentioned. All Vallejo del Potro or VDS needs now is the 10% to cover the lawyers and court costs and the money will be released.

This payment is to go a bank account in the name of an individual.

Research has shown that Vallejo del Potro registered their website www.vallejodelpotro.com on the 9th of October 2013

Their address in Madrid; Calle del Desegaño S/N 28004 Madrid is a FAKE address.

Their phone number +34 602 679 233 is a mobile phone that can be ringing anywhere in the world, and their fax +34 911 881 1390 is most probably virtual as well.

We can assure you that there is no such company as Vallejo del Potro, not in Madrid and not anywhere in Spain. Neither is there a court case with money set aside for the victims.

Joaquin Santiago Abogados, the fake lawyer from Madrid.

A new cold calling company has been spotted by the name of Joaquin Santiago Abogados.

This dubious lawyers office claims to be based in Madrid on the following address: 7, Plaza General Vara Del Rey, Madrid, 28005

Their telephone number is 0034 911 23 94 31 and email js-abogados@spainmail.com

They contact consumers who previously have been defrauded by dubious claims companies. They seem to know all about this previous fraud and explain that the company in question went into liquidation.

Due to this liquidation, the consumer was never notified that his claim was successful.

But Mr. Joaquin Santiago and the account manager Ms. Monica Toris can help the consumer with recovering the money awarded.

All he needs to do is pay £1000 Notary fees. This can be paid by bank transfer to a company in the UK.

Please note that there is no such lawyer’s office by the name Joaquin Santiago in Spain and neither was there a liquidation of a dubious claims company.

We can only suspect that the initial £1000 is not the end of the story and more payment requests will follow to “unblock” the awarded money.

Expensive Vacation Dreams: Critical TV programme by the Danish National broadcaster on Gran Canaria.

DR1 a Danish national TV channel produced by the public service broadcaster DRI has aired on its Consumer Programme Kontant (Cash) a feature where it warns against the discount travel membership club (holiday club) Compass currently sold in Southern Gran Canaria.

Compass is the replacement of Voyager Travel, latter discount travel membership club, raided by the Spanish Police in July 2013 in Gran Canaria.

We remind the reader of Mindtimeshare that there are preliminary proceedings open against Voyager Travel and seven ringleaders of this holiday club, who have been formally charged with fraud and criminal association.

The German national Eugen Friedrich Kaiser would be the main person behind Voyager Travel and linked companies.

So despite the preliminary judicial proceedings, the very same people charged for running Voyager Travel, have not wasted a second, creating a new discount travel membership club, Compass, using a similar modus operandi.

Basically they have had no qualm to continue defrauding the tourists who visit Gran Canaria.

And a very prestigious Consumer Programme Kontant of the Public funded Danish TV has reported on the activities of the discount travel membership club, Compass.

Journalists of the TV DR1 Channel visited Gran Canaria, but not to inform about the wonders of the island, but to make a very critical consumer programme on Compass Holiday Club, the replacement of Voyager Travel.

The title of the programme Kontant (cash) broadcasted on November 25th was Expensive Vacation Dreams.

“Gran Canaria in the Canary Islands, is swarming right now with Scandinavian tourists. And they will most likely run into some energetic sellers offering them a free scratch card.

A scratch card, which is as likely to result in gains: an I-pad or a week’s hotel stay in Gran Canaria. And who will reject the offer of a free taxi to pick up the prize at a hotel nearby?

Unfortunately, it is not so easy. Before you know it, you are participating in an hour-long sales pitch about cheap holidays. And it all sounds mighty appealing, telling people who have tried it, as Christine Jakobsen and her husband Bjarne. They bought in April a large pack of prepaid hotel weeks over the world for 56,000 Danish Krones (7,507 Euros). 

The seller worked for the company Voyager Travel, now called Compass:

– They offered us 10 travels worldwide at 4 – 5 Star hotels at a cost of 8,500 euros and if we paid the same day, we could save 500 euros.

It sounded so compelling that the couple signed and paid the first 30,000 Danish Krones (4,021 Euros), but Christine felt that everything went too fast, asking herself:

– What are you doing here? I went to the bathroom and vomited.

– We were pressured into something that we couldn’t foresee, because everything must go so fast and we did not get the chance to think through it.

– Where will be staying in holidays? 

– We got a list that I have here, which is about 15 destinations. Canary Islands, the Caribbean, Costa del Sol, Cyprus, Madeira, Malta, Mexico, Portugal, Thailand, etc.” 

Christine and her husband discovered only when returning home in Denmark that they had signed on oral/verbal promises but that the guarantees were invalid – but they had signed that the contract had been concluded without any form of coercion and blackmail.

And contrary to what Christine and her husband were promised, they can only go on holidays to four countries in addition to Spain, and that the standard of the hotels offered were lower than the promised ones.

They were shocked when they discovered that there were hundreds of similar consumer cases to theirs.

Many complaints

Kontant TV programme has talked to a number of Danish nationals who tell them about how they have been tricked by the smart – often Danish – sellers for hours and promised access to a world of attractive hotels.

Sales pitches that are so effective that the consumers cannot think straight and end up not reading their contracts properly before they sign and pay.

The European Consumer Centre in Denmark, which handles complaints about foreign holiday clubs, dealt last year with 19 Danish enquiries about holiday clubs. This year there has been twice as many enquiries from disappointed Danish consumers, says Martine Kiding, lawyer and director of The European Consumer Centre in Denmark:

– They have been promised a withdrawal that is not included in the contract. They might have been promised a stay at a particular resort, yet it is not part of the contract.

The European Consumer Centre in Norway is experiencing the same types of complaints. Norway is close to 200 cases of travel clubs.

Kontant TV programme has shown Christine and Bjarne Jakobsen’s contract to Martine Kiding, who has particularly highlighted one thing of the contract: The agreement runs for 9 years.

– If a contract includes a product that lasts for more than a year, then it will be covered by the Timeshare Directive, and as a result consumers should be given a right to cancel it during the first 14 days – i.e. cooling off period.

But the contract signed with Compass indicates nothing about a cooling off period of 14 days.

Martine Kiding adds that the Timeshare Directive forbids the taking of deposits before the cooling off period is over. Basically these discount travel membership clubs cannot take any money upfront until 14 days had passed since the signing of the contract.

Christine and her husband paid 30,000 Danish Krones (4,021 Euros) on the spot, on the same day that they signed their contract with Compass!

As a result the discount travel membership club Compass violates by all accounts several points of the European Directive.

The Holiday Club rejects criticism

Compass Danish Sales Manager at Gran Canaria, Michael Gadman, declined to be interviewed for Kontant, Consumer Programme, but through the company’s Spanish lawyer sent an e-mail, where he states:

– The scratch cards are a recognized method of sale in Gran Canaria.

– The sellers are authorized locally.

– That no one is forced to participate in sales meetings.

– The company affirms that no one signs under pressure, something that Christine Jacobsen and her husband agreed, signing a document that proved it.

– Compass believes that the contact signed by this couple, is not covered by the European Directive, which covers Timeshares and Long-Term Holiday Products (i.e. Discount Travel Membership Clubs).

Conclusion

The Association of Mindtimeshare has been allowed by the judge to participate as a party in the criminal prosecution against Voyager Travel and linked companies, court case taking place in the Courts of San Bartolomé de Tirajana in Gran Canaria.

As a result we believe that other local authorities should get involved also in this Court case. We want to make an appeal to the Public Institutions of the Canary Islands, Gran Canaria, San Bartolomé de Tirajana, and Mogán Councils, to contribute to make certain that the image of Gran Canaria as a safe holiday destination is not tarnished even more.

How is possible that some persons who have been charged with fraud and criminal association for the selling of the discount travel membership club – Voyager Travel – are allowed to continue selling a new discount travel membership club – Compass – which is similar to the previous one, using the same sales practices, in the same location, and acting with complete impunity?

Are we going to wait that the rest of the European Televisions come to Gran Canaria to report on these discount travel membership clubs, damaging even more the island´s reputation as a safe holiday destination?

Dear politicians this is not the first time that the European Media reports on Voyager Travel, and it is high time to act. It is unbelievable that this is happening in a so-called developed country.

Caros sueños de vacaciones, programa crítico de la TV Danesa sobre Gran Canaria.

Una TV Danesa, de ámbito nacional, emite un programa sobre consumidores, donde alertan sobre el club de descuento de vacaciones Compass, comercializado en el Sur de Gran Canaria.

Compass es la continuidad del club de descuento de vacaciones Voyager Travel, intervenido por la Policía española en Julio de 2013, en la Isla de Gran Canaria.

Recordemos al lector que existen unas Diligencias Previas abiertas contra la empresa Voyager Travel y otras, en la que hay siete personas imputadas por presuntos delitos de estafa y Asociación Criminal.

El alemán Eugen Kaiser aparece como responsable final de toda la presunta trama delictiva.

Pues bien, los imputados en las Diligencias Previas mencionadas, sin la más mínima vergüenza, han creado un nuevo club de descuento de vacaciones, denominado Compass, con el mismo “modus operandi” que Voyager Travel, y se han puesto a operar nuevamente.

Es decir, sin ningún tipo de reparo, están volviendo a engañar a los turistas que visitan Gran Canaria.

Y resulta que una TV Danesa, de ámbito nacional, ha hecho un programa para denunciar estos hechos.

Periodistas de la cadena de TV DR1 – Primer canal de la TV pública de Dinamarca – se desplazaron a Gran Canaria, pero no para promocionar las bondades de la Isla de Gran Canaria, sino para realizar un crítico programa de consumidores, donde se alertaba sobre la empresa Compass Holiday Club, el sustituto de Voyager Travel.

El título del programa, emitido el pasado 25 de Noviembre de 2013, fue Caros sueños de vacaciones.

“Gran Canaria llena de turistas escandinavos en estas fechas, dispone de enérgicos vendedores en las calles ofreciendo productos de vacaciones con el sistema de tarjeta rasca-rasca.

Una tarjeta rasca-rasca que supuestamente te proporciona regalos garantizados que van desde un I-Pad hasta una estancia de una semana en un hotel de Gran Canaria. ¿Quién va a rechazar la oferta de subir a un taxi para recoger el regalo en un hotel cercano?

Desgraciadamente, no es tan fácil como lo pintan. Sin darte cuenta te ves envuelto en una charla sobre cómo conseguir vacaciones baratas, con una duración de varias horas. Charla que resulta atractiva, informando sobre personas que ya lo han probado, como Christine Jacobsen y su marido Bjarne. Quienes compraron en Abril un paquete de vacaciones de semanas de hotel a lo largo del mundo, por valor de 56.000 coronas danesas (7.507 €). El vendedor trabajó para la compañía Voyager Travel, ahora llamada Compass:

“Nos ofrecieron 10 viajes alrededor del mundo, en hoteles de 4-5 estrellas, con un coste de 8.500 €, que si pagábamos el mismo día, nos podríamos ahorrar 500 €”

Sonaba tan irresistible que la pareja de turistas firmó y adelantó un pago de 30.000 coronas danesas (4.021 €).

Pero Christine sintió que todo iba muy rápido, preguntándose a sí misma:

– “¿Qué estás haciendo aquí? Y fui al baño y vomité”

– Fuimos presionados para comprar algo rápidamente, sin poder pensar con calma lo que hacíamos, sin poder prever las consecuencias.

– ¿Qué lugares y hoteles eran los que ofrecían?

– Nos proporcionaron una lista de 15 destinos: Islas Canarias, Caribe, Costa del Sol, Chipre, Maderia, Malta, Méjico, Portugal, Tailandia, etc.

Al volver su casa en Dinamarca, Christine y su marido descubrieron que lo que habían firmado eran simples promesas verbales, sin ningún tipo de garantía – pero el contrato contenía cláusulas específicas que decían que la firma del mismo se hacía sin ningún tipo de coerción o chantaje.

La verdad era que sólo podían ir de vacaciones a cinco países, incluido España, contrario a lo que les habían prometido. Y que el estándar de calidad de los hoteles era mucho menor que el que les manifestaron verbalmente.

Nos quedamos en estado de shock cuando supimos que había cientos de víctimas en una situación similar a la nuestra.

Muchas reclamaciones

El programa Kontant TV ha hablado con varios consumidores daneses que manifiestan haber sido engañados de una forma inteligente, por vendedores (a menudo daneses) que durante horas prometían acceso a atractivos hoteles alrededor del mundo.

El proceso de venta es tan efectivo que no permiten a los consumidores leer correctamente las cláusulas de los contratos antes de firmarlas.

El Centro Europeo del Consumidor en Dinamarca, que trata reclamaciones sobre los clubes de descuento de vacaciones, el año pasado recibió 19 reclamaciones sobre los clubes de vacaciones. Este año se han duplicado las reclamaciones de decepcionados consumidores daneses, según manifiesta Martine Kiding, abogada y directora del Centro Europeo del Consumidor en Dinamarca.

– Se prometen devoluciones de dinero que no están incluidas en el contrato. También pueden que se hagan promesas de estancias en un complejo, el cual tampoco forma parte del contrato.

El Centro Europeo del Consumidor en Noruega están recibiendo el mismo tipo de reclamaciones. El número de reclamaciones sobre clubes de vacaciones se acerca ya a las 200.

El programa Kontant TV ha mostrado el contrato de Christine y Bjarne Jakobsen a la directora del ECC en Dinamarca, Martine Kiding, quien ha resaltado una cláusula importante: La duración del contrato es de 9 años.

Y si un contrato de este tipo tiene una duración de más de un año, entonces está garantizado por la Directiva Europea, y por tanto, el consumidor europeo tiene el derecho de cancelación del mismo, en siguientes 14 días tras la firma del contrato.

Pero el contrato firmado con Compass indica que no es aplicable el periodo de reflexión de los 14 días.

La Directiva Europa también dice que los contratos que omitan los 14 días de reflexión, pueden ser cancelados durante el primer año de su duración.

Martine Kiding añade que la Directiva Europea prohibe la toma de depósitos antes de la finalización del periodo de reflexión. Es decir, este tipo de empresas tampoco pueden coger dinero por adelantado hasta que no hayan pasado 14 días tras la firma del contrato.

Christine y su marido pagaron 30.000 coronas danesas (4.021 €) el mismo día de la firma del contrato.

Por tanto, el club de vacaciones Compass está incumpliendo varias normas de la Directiva Europea.

El Club de Vacaciones rechaza las críticas

El director de ventas danés de la empresa Compass de Gran Canaria, Michael Gadman, declinó ser entrevistado por el programa de consumidores Kontant, pero esto fue lo que manifestó el abogado español de la empresa Compass:

– Las tarjetas rasca-rasca son un método de venta permitido en Gran Canaria.

– Los promotores están autorizados por las Autoridades Locales.

– No se fuerza a nada a participar en las reuniones de venta.

– La compañía asegura que no se fuerza a nadie para que firme el contrato, como así se puede probar en el documento que firmaron Christine Jacobsen y su marido.

– Compass cree que el contrato firmado por esta pareja no está cubierto por la Directiva Europea.

Conclusión

La Asociación Mindtimeshare participa como acusación particular en el procedimiento penal que se está llevando en los Juzgados de San Bartolomé de Tirajana contra estas empresas.

Pero creemos que otros deben implicarse más. Queremos hacer un llamamiento a las Instituciones Públicas de las Islas Canarias, de Gran Canaria, del Municipio de San Bartolomé de Tirajana y del Municipio de Mogán para que pongan de su parte para evitar que su imagen turística se vea perjudicada todavía más.

¿Cómo puede permitirse que unos individuos que están imputados por presuntos delitos de estafa y asociación criminal, por la comercialización de un producto de vacaciones, se encuentren comercializando actualmente un producto de vacaciones idéntico en el mismo lugar y con total impunidad?

¿Vamos a espera a que el resto de televisiones europeas vengan a avergonzarnos?

Señores políticos, aquí llueve sobre mojado. Es inconcebible que esto esté ocurriendo en un país que se supone avanzado.

As far as we know this company Sell My Timeshare Fast is not cold calling, but in case they do contact you or you fill in the form, please be careful.

People cannot be warned enough about being careful when leaving personal details on the internet with companies that don’t identify themselves properly and you don’t know where your details are going to end up.

Recently we have detected a strange website from a company called Sell My Timeshare Free.

This website http://www.sell-my-timeshare-free.co.uk/ which was created in October 2013, lacks certain information that one would expect to be on a web of a genuine company.

There is no Companies House Registration. They do display an address which is: Westview Court 25 Kent Road, DA1 2AA Dartford, England

Telephone 0208 123 0727

There is no email address.

Neither is there any Timeshare property displayed on the web, which is a bit strange for a company selling timeshare. Would you not have a display of the products on offer?

On a daily basis new companies and new websites are created. It is important that Timeshare owners who are looking for resale, always do research on the companies they are intending to use.

Companies that are not duly identified and seem to lack information should be handled with caution.

Cold callers and upfront fees are a definite NO.

Impact Services Spain & Holiday Impact Services, the cold callers from Tenerife.

Recently we have been made aware of a cold call campaign from Holiday Impact Services to attract consumers.

Timeshare owners (mainly from Tenerife) are being also targeted through cold calls with promises to help them to get out of their contractual timeshare agreements. Basically they seem to be acting as a timeshare disposal service.

The main marketing company behind this set up though is Impact Services Spain SL which is selling a Gold Crown Resorts membership. Together with the membership they also offer a Cash Back, which will provide the member the possibility to recuperate the money paid for the membership.

In December 2012 we published an article on this blog about Impact Services Spain. (http://wp.me/p1kmoi-F9) In this article we explained about this company and their way of using OPC’s in the streets of Tenerife to take customers to their sales decks and sell them a dubious Holiday Club Membership.

Their sales deck is situated currently in Colina Blanca San Eugenio Alto, 10-30, Adeje.

What has been noticed is that the cold call campaign is almost exclusively targeted towards members of one particular resort. It is therefore to be questioned how Holiday Impact Services has obtained the information from the members of this resort. It certainly doesn’t look good that an ex-employee of this resort seems to be the one cold calling. This is a clear symptom of an alleged fraudulent use of the information, and therefore likely to be reported to the Data Protection Agency of Spain.

We have to insist to those Timeshare owners who are approached by Holiday Impact Services or Impact Services Spain on a cold call, to be extremely cautious. Although the person calling might be known to you from previous visits to the resort, it is certainly not a correct way of working and we have serious doubts about their main objective of this call.
