Consumers have now started to receive cold calls from a company called:

The “Modus Operandi” stays the same as mentioned in our article: “Have you received a call from a lawyer in Tenerife to join an upcoming claim?”

Please be careful when receiving such fake offers over the phone and do not submit any further personal details to these companies.

Timeshare Cold Callers September 2017

Dear All,

Welcome to the month of October 2017!

The new cold caller list is here and we have counted 51 company names this month.

From the 51 cold calling companies, a surprising 18 companies were completely new.

We have to say that some company names are actually taken from real existing companies. This is extra confusing when a consumer is cold called and tries to do a bit of research.

The company name comes up and the consumer is likely to think that everything then might be ok.

Please be careful with this!

The fact a company is registered does not always mean the company is not telling you lies.

So don’t only guide yourself by the fact a company seems to have a registration number and do certainly more checks on contact details, telephone numbers etc.

Special attention to the email address. Most companies nowadays, even those who don’t really have an own website, do have their own domain name (company name). So email addresses ending with gmail.com, mail.com, account.com etc. should be treated with caution.

Have you received a call from a lawyer in Tenerife to join an upcoming claim?

Sad but true, for over a year now we have been seeing inquiry after inquiry from timeshare consumers who have been approached by fake lawyers supposedly based in Tenerife.

All the offices seem to have the same pitch.

They claim to be lawyers acting in the Tenerife courts, and a claim against your resort is shortly due and you can still join.

The lawyers work on a “NO WIN NO FEE” basis, but soon after the consumer shows their interest this changes to “certain fees due prior to be paid out”.

You name it and they will ask for it, Translation fees, procurator fees, lawyer fees, court fees, taxes due, etc. etc.

If the poor consumer is still holding on to them after paying all these fees (and yes sad enough there are victims who went through these stages) supposedly a cheque is being posted to the victim.

But guess what? The cheque is lost in the post! The victim receives an empty envelope.

This is yet again a follow up on an already very ugly scam, and from this moment the victim is led to believe that a new lawyers company is handling the case of the lost cheque. And yes, one more time some fees are due…

For as much as we have been posting blog warnings over the past year, still at this stage we receive emails from consumers who are actually quiet taken by this all, and find it hard to believe it isn’t true.

Of course, they receive (fake) court documents, pages long explanations on how good and experienced the lawyers are. Names and ID Numbers of lawyers are thrown into the text…websites seem to come out of the woodworks for each one of them and even a copy of the cheque is attached.

Overwhelmed with all this information, consumers don’t always think that it is necessary to double-check any of the details and they just go ahead.

But not only the names of the lawyers don’t exist, or as a matter of fact the whole court claim they go on about…the cheque of the bank, the BANESTO bank is fake as well and this bank does no longer exist. Banesto was taken over by Santander 5 years ago. So nobody will issue a cheque in the name of a bank that no longer exists.

Seen the extend of this fraud, (and the numerous victims counted by us so far) we can only fear the worse on how much money these scammers have really put in their pockets.

Consumers always ask us, why does the police not act?

And actually part of the answer is quiet simple. Because not all victims report this to the police and probably this is why the police has no idea of the actual extend of this scam.

With this article we are not only trying to “refresh” the information on the names used so far, we also want to ask all victims to step forward and report this to the police, to Action Fraud and if travelling to Spain, to the Spanish police.

DO NOT LET THEM GET AWAY WITH THIS!

Fraudsters survive based on the shame and embarrassment their victims feel when they realize they have been defrauded and avoid telling anybody about this, not even the police.

Beware of the cold calls from a company Abastar Concursales (fake) about your Cashback Certificate.

This cold caller was detected early September 2017.

Abastar Concursales (fake) seems to be approaching consumers who are holding a Cashback Europe Certificate.

Although the consumer claimed the money from the certificate and didn’t receive anything, Abastar Concursales as the liquidators of Cashback Europe state they can now claim again.

The consumers, as creditors of Cash Back Europe, just need to fill in some claim forms and select if they want to be paid out by bank transfer or cheque.

Once they submit the forms, Abastar Concursales will process the claim and get the money to the consumer.

But after some days the consumer receives a letter from Abastar Concursales stating the bank are querying payment as it is over 1,300 euros.It turns out that the consumer needs to pay Spanish tax and is offered 3 different options to do so.

Of course the options of travelling to Spain, queuing up at a Tax Office for hours, or appointing a lawyer who needs to get it all translated and will ask for silly money…are not really the options one would look for.

So the offer from Abastar Concursales to fill out the necessary forms and appoint a fiscal who will sent a tax bill to pay tax office direct, sounds like the best choice.

Don’t you think so?

The consumer is sent all kinds of documentation with their names and numbers, and a name of the supposed fiscal, a Mrs. Elizabeth May Helme who declares to be the legal representative of the consumer.

Although it all looks very official, we can assure you that the forms are downloaded copies of the Internet, filled in without making any sense!

The consumer is asked for around 3000 euros of “tax”, to be transferred into a bank account without an account holder’s name.

The strange calls from the Malaga Magistrates High Court

On the cold caller lists we have names that pop up each month or every now and then, but there don’t seem to be a very “active” call campaign going on.

That is the case with the calls received by timeshare consumers from a lady called “Linda Kirk” claiming to be working for the Malaga Magistrates Court as a translator,

Linda from the High Court in Malaga reminds the consumer that he has an outstanding claim for compensation.  It relates to a judgement from a couple of years ago in which a large number of companies were prosecuted and fined to provide the compensation.

The amount the consumers are due are around the £10,000 and all the consumer has to do is pay a court appointed Spanish Lawyer 10% (approx. 1000 Euros) via Bank Transfer and the money will be released.

The contact phone number from Linda is a Spanish mobile: 0034 602 699 804 but other numbers have been mentioned to us as well, a UK number 07405 247 254 and another Spanish mobile 0034 603 221 8610

Linda isn’t very keen on emailing, and almost all the information she provides is given over the phone.

The money due for the lawyer needs to be paid into a bank account in the name of an individual who apparently holds an account in Fuengirola on the Costa del Sol.

Although we don’t have that much information about the above bogus set up, it is important to warn all consumers about them, and certainly be extremely careful when you receive this call from the “High Court”

Did you get a call from Joint Returns Legal Consultants?

Joint Returns Legal Consultants are as many consumers say a “persistent cold caller”

The person on the phone, identifying himself as Peter Sanchez, seems to have a lot of patience and is not taking a no for an answer.

Joint Returns Legal claims to be appointed by the High Court to inform consumers, victims of frauds about money awarded to them through the High Court.

Claims of close to £30,000 have been settled and the high Court is keen to pay the money to the victim, who so far seems to be completely unaware of their “luck”.

Peter Sanchez, after contacting the consumer by telephone, sends a confirmation email where he attaches all kinds of official looking documents with the header of the “Agencia Tributaria” which is the Spanish Tax Office.

Joint Returns Legal Consultants want to go ahead with transferring the money to the consumer but first the consumer will have to pay certain expenses made and outstanding fees such as an Embargo, Notary and Admin fees. The amount is £998.

This money has to be paid into a bank account under the name of an individual.

As Peter Sanchez explains, the money is being held by the Spanish Judiciary in the form of a banker’s draft and will be released subject to payment of the unpaid fees.

To back up all the statements the consumer also receives a letter from supposedly the BBVA Bank, who declares that the BBVA will IRREVOCABLY HONOUR AND GUARANTEE payment of any checks written by the “Gobierno De España” or Agencia Tributaria.

This letter is stamped and signed by a Notary with the name of Jose Miguel Perez

A rejection of this claim needs to be returned within 12 working days or the claim will be deemed acceptance, so they will pursue the consumer for the £998

Peter Sanchez does not cease his calls, and when the consumer expresses his doubts or simply is not interested in going ahead, he states the claim has already gone through and the consumer has to pay.

Please note there are no claims through the High Court, and neither is there any money held by the Spanish Tax offices or the High court to be paid out.

Do not send any personal information to this Peter Sanchez from Joint Returns Legal Consultants and certainly do NOT pay any money!

Beware of the fake legal company Cabinet Advice Law Firm!

This warning is mainly for French speaking Timeshare consumers who have been defrauded in the past by bogus resale companies working from Morocco.

After losing money to a fake resale company called European Trade Center, the follow up on this scam has arrived in the name of Cabinet Advice Law Firm.

The person calling from Cabinet Advice Law explains to the timeshare consumer that European Trade Center has gone into liquidation.

And the consumer can claim the money he paid to this bogus company through Cabinet Advice Law.

In order to do so, they ask the consumer to send all copies of the documents they have related to their dealings with European Trade Center.

Taking into account that the company European Trade Center was all fake and they disappeared after taking the consumers’ money, there is no doubt that Cabinet Advice Law is another bogus set up, coming back for more!

Pas op voor de aanbieding van de nep-advocaat Gonzalo Calderon!

Een nieuwe naam op onze lijst van nep-advocaten en dat is Gonzalo Calderon.

Momenteel lijkt het dat ze alleen Nederland sprekende Timeshare-eigenaren benaderen, maar waarschijnlijk zullen ze ook naar andere nationaliteiten uitbreiden.

In het eerste telefoon gesprek legt de medewerker van dit nep advocatenkantoor uit dat zij een gespecialiseerd juridisch kantoor zijn die rechtszaken doet tegen timeshare-bedrijven.

Gonzalo Calderon werkt op een “No Cure No Pay” basis, dus als de zaak verloren is, hoeft de consument niets aan hen te betalen. Maar als de zaak is gewonnen, is er een betaling van 10% over het toegekende bedrag.

Zij leggen meteen uit dat deze 10% verschuldigd is wanneer de consument de schriftelijke bevestiging van de rechterlijke uitspraak ontvangt.

Zo leggen zij dit uit in hun e-mail: ” Indien de uitspraak negatief uitvalt, te zeggen de vorderende partij krijgt geen bedrag toegewezen, hoeft deze ook niets te betalen, zelfs niet voor de door ons uitgevoerde voorbereiding. Indien het gerecht aan U wel een zeker bedrag toewijst, zijn gerechts- en administratiekosten ter hoogte van 10 % te betalen, maar eerst eens dat U de uitspraak in Uw voordeel zwart op wit voor U liggen hebt. Het aan U toegewezen bedrag staat vanaf dan op een fiduciaire bankrekening van het gerecht op Uw naam als begunstigde geboekt en kan dus niet verrekend worden…”

Oh ja, dus je krijgt een brief / document alsof het de uitspraak is van de rechter en die bevestigd dat er een bedrag is toegekend en dan wordt verwacht dat je eerst deze 10% over dit bedrag gaat storten alvorens iets te ontvangen?

De website van Gonzalo Calderon http://www.gonzalocalderon.com is slechts 1 maand geleden geregistreerd (augustus 2017).

Er is geen bedrijfsregistratienummer (KvK Nummer) op het web en geen privacyverklaring. Zeker heel vreemd voor een bedrijf dat beweert een advocaten kantoor te zijn die toch zeker op de hoogte zal zijn van de wetgeving betreffende websites!

Beware of the cold calling and fake lawyer Gonzalo Calderon!

A new name has popped up in the list of cold calling fake lawyers and this is Gonzalo Calderon.

For the moment it looks like they are only approaching Dutch speaking Timeshare owners but of course they will probably extend the calls to other nationalities.

On the cold call the employee of this fake lawyers office explains they are a specialist legal office doing claims against timeshare companies.

Gonzalo Calderon works on a No Win No Fee basis, so if the case is lost the consumer doesn’t owe them anything. But if the case is won, there is a 10% fee over the awarded amount.

They explain straight away that this 10% is due when the consumer receives the written confirmation of the court ruling.

The catch is in the following sentence of their email: “The amount allocated to you will be transferred to a fiduciary bank account of the court, and the fees due cannot be deducted from the awarded amount…”

Oh yeah right, so you get a letter / document pretending to be the court ruling, telling you there is an amount awarded to you, and then you are expected to send the 10% over this amount first before receiving anything at all?

Please note that the website of Gonzalo Calderon http://www.gonzalocalderon.com was registered only 1 month ago (August 2017).

There is no company registration number on the web, and no privacy statement. Surely very strange for a company claiming to be “legal” professionals!

Beware of the FAKE LAWYERS in Tenerife using the name of Amador Galeca!

Oh yes, if we hadn’t had enough already, we have another name added to the endless list of cold calling fake lawyers offices based in Tenerife. This time the have taken the name of Amador Galeca.

The website www.amadorgaleca.com states this supposed lawyer has been around for at least 25 years, which is really surprising for somebody who’s name cannot be found anywhere, and neither a company registered under this name.

They cold call Timeshare consumers who were defrauded before and explain there is an upcoming court claim where the consumer can join in and claim their money back and compensation as well.

There are no charges to do this, so it all seems very plausible at the beginning.

The real “game” actually starts when the consumer is notified a settlement has been offered or there has been money awarded, and in order to go ahead there are fees to be paid.

Notaries, procurators, translations, you name it they need money for it!

A range of fake documents is produced by email to back up their lies.

For example tax documents often taken from the Internet and although in Spanish they are really from South American tax offices.

All the fees have to be paid by bank transfer, and again there seems to be a wide range of “procurators and notaries” with all kind of “exotic names”.

As with most of these fake companies, there doesn’t seem to be an end to the requests for money.

Only when the consumer has paid over and over again and there is no progress at all and certainly the supposed awarded money has not been received…they realise it is a scam.

Website alert for www.TheClaimFinders.co.uk

Not always a company has to be a cold caller to recommend caution. We also do in those cases where we detect a website or publicity of companies that offer services related to Timeshare but don’t seem to be all that transparent.

This is the case of the website called www.TheClaimFinders.co.uk

The website has been registered only at the beginning of August and they have protected the names of the registrant, which is not something a genuine and normal company would do.

For a website which is only around 6 weeks old, the statement of “having helped thousands of clients who have had their cases upheld and have now been awarded millions of pounds in compensation” seems a bit exaggerated to say the least.

On the same website there is no mention at all about a company registration, no Companies House number, no address, nothing which is actually obligated by law for company websites.

There is no privacy statement or anything, so they don’t really promise they will protect your personal details if you happen to fill in their contact form.

A consumer who spoke to them though, told us that when he asked for their address the person on the phone said she could not provide these details in view of Data Protection!

In the small print they mention: “www.theclaimfinders.co.uk are a web-based service introducing you specialist companies and their services within the Timeshare and Holiday club claims sector. www.theclaimfinders.co.uk do not charge for this facility and are paid by the companies themselves. http://www.theclaimfinders.co.uk only refer people to No Win No Fee companies.”

Contact email is CLAIM@THECLAIMFINDERS.CO.UK and the person calling back after the initial inquiry send out to them is calling from telephone number: 0203 455 4602

Please when searching the web and running into websites like this, be careful with the information you fill in and provide to companies / people who are not duly identified.

Filling in forms like this can lead to receiving numerous cold calls throughout the years as your personal details can be passed from one to another.

Leyland Marketing Consultants another cold calling “Appointment Setter”

We have already many names for companies claiming to be sole “Appointment Setters” for other companies, and Leyland Marketing Consultants is one more to complete the list.

This cold calling marketing company pretends to be acting on behalf of different legal companies, and the agent calling discusses the claim as if they have a certain legal qualification.

In the follow up email they send out to the consumers after the initial cold call, Leyland Marketing Consultants states the following:” We here at Leyland Marketing Consultants are a claims validation consultancy, whose role is to establish which timeshare and point owners are eligible for compensation, due to the mis-selling of timeshares. We are predominantly dealing with Time Share members for the potential breach in their contracts…”

But on their website they actually don’t mention anything of the above at all! This is how they explain who they are: “From Leyland Marketing Consultants we offer an honest and ethical approach to sales and marketing but at the same time ensuring that persuasion and influence tactics are used to their fullest. With over of 50 years of combined marketing experience at the head of the company, we know how to make your business the best it can be.”

Both calls and follow up emails are very similar to the pitches we have seen before from other companies, and surprisingly all consumers have their claim validated as possible.

No consumer has ever been turned down!

The supposed claim to recover the money paid to the timeshare resort will be on a 25%/75% split and in order to join this claim the consumer needs to attend a meeting.

As always we recommend consumers to be extra cautious when receiving cold calls from companies stating they are legal professionals or connected to legal companies.

Bias Claims Services the legal company appointed after the police raids…

A cold calling company using the name of Bias Claims Services has started their active call campaign in the past week.

This company approaches consumers who have been defrauded in the past, mainly by bogus Timeshare resale companies.

The employee of Bias Claims Services knows everything about this unfortunate fraud, to the extend that they can tell the consumer the exact amount of money paid and to which company.

Apparently Bias Claims Services is taking a large group of bogus companies to court on behalf of numerous victims…

The employee Jane Davis explains to the consumer that they are on a list of victims provided to her company to contact. According to her the case is going to Court for hearing on the 17th November in Madrid and involves some 500 victims and over £1000.000 in money.

Good news is that the Spanish Government are paying all their costs in the matter but the consumer would need legal representation at the hearing and Bias claims Services can offer this, against a payment of course!

First of all, there is no such company registered at the Spanish Companies House by the name of Bias Claims Services.

There is no such company doing any group claim against a large group of companies, and certainly the Spanish government is not involved in such claim and paying for the costs…

Obviously if the company does not exist, neither are there any lawyers / solicitors doing any claims!

If a consumer is identified, as a possible victim of a fraud by the police, the consumer would be contacted by the court directly through an official communication in Spanish, duly translated by a sworn translator and by recorded delivery post.

The victim is notified of the possibility to claim against the company / people who defrauded them and is asked by the court to notify if they have intention to do so and appoint a legal representative.

Cold calling alert for a company called Stapleton Consultancy!

A company called Stapleton Consultancy of Leeds are cold calling timeshare consumers who have been defrauded in the past.

Stapleton Consultancy is offering to recover money, which was lost by the consumers when paying bogus Timeshare resale companies.

Surprisingly the agent from Stapleton Consultancy has all the details of the transactions made by the consumer with those bogus companies and knows the exact amounts paid to them.

They claim there is compensation owing to the consumer, which is awarded by Spanish courts and is currently held in Spain.

In order to release the money to the consumer, Stapleton Consultancy can help!

Of course nobody works for free and neither does  Stapleton Consultancy so they need a payment before they can do this service for the client.

They can only accept bank transfers though.

Although we have no further information at the moment, with the above details there is sufficient information to alert consumers about this company, and to recommend caution when speaking to them!

There are no monies awarded through courts in Spain! There are no companies appointed by the Spanish Government to contact consumers to recover the money they lost through fraud!

Cold calling companies who have all the details of your unfortunate dealings with bogus companies in the past are NOT TO BE TRUSTED!

Barlow & Scott and the case of the missing NIE number…

Barlow & Scott are cold-calling consumers claiming to be a solicitors office from York.

Telephone numbers of these so called solicitors Barlow & Scott is: 01904 501 389

The consumers they approach all seem to have one thing in common which is the fact they all purchased a Club Class membership in the past.

The story told by the agent of Barlow & Scott is that there is money being held by the Trustees for Club Class Claims.

It appears that the actual purchase of the Club Class membership by the consumer was never properly completed due to the fact the consumer did not have an NIE number.

The consumer can claim now a refund of the money paid to Club Class, but of course he would need to arrange for this “missing” NIE number first.

And yes, you guess right, here we have Barlow & Scott who offer a helping hand and for £500 this issue can be solved.

For the moment we have been unable to trace a company on the Companies House register by the name of Barlow & Scott.

Neither is there something as “Trustees of Club Class Claims”

NIE numbers are Spanish Tax ID numbers, and you certainly do NOT need such number when buying into a Discounted Travel Membership Club such as Club Class, as you are not buying any property or similar. So the story if the missing NIE is completely nonsense!

Appointing Consultants, setting appointments through cold calls.

A new cold caller has appeared by the name of Appointing Consultants.

New name, but not really a new pitch.

They are surprisingly similar to several other cold callers that have been making appointments for meetings to discuss claims against the resorts.

Their website – www.appointingconsultants.co.uk/ -, registered only this month of August also looks familiar.

Although the website indicates they are a company that can help businesses with the different aspects of their marketing, and for example make appointments on their behalf, the people calling from this “Appointing Consultants” go as far as assuring the consumers that they have a good base to claim against their resort.

Something that seems a bit odd for a telemarketer who is hired to make appointments on behalf of a third party company.

Contact details of Appointing Consultants are an email address admin@appointingconsultants.co.uk and a telephone number: 0121 667 3458 which is not mentioned on the web.

Neither is there any Company House registration number or office address.

For as much as the caller might sound convincing, please always be careful with cold calls.

Ask them the basic questions of “how did you get my personal / private details?” “On behalf of which company are you calling?” “Who is actually doing this meeting?”

“What are the company details? Address, Companies House registration, etc…

Heeft u al gesproken met een advocaat genaamd Berlanga Contreras in Madrid?

Een nieuwe, vreemde advocaat met de naam Berlanga Contreras is onder onze aandacht gebracht.

Op dit moment lijkt dit advocatenkantoor, dat vermoedelijk in Madrid is gevestigd, zich alleen aan Nederlandse / Vlaamse Timesharing eigenaar te richten, maar dit kan uitgebreid worden naar andere talen.

De persoon die namens Berlanga Contreras belt, gebruikt de naam van Jeroen Bosch.

Hij legt aan de Timeshare-consumenten uit dat het advocatenkantoor Berlanga Contreras elke maand verschillende claims indienen tegen timeshare-resorts, en ze winnen ze allemaal! Hoe succesvol kan je zijn?

Als de timeshare-consument zich wil aansluiten bij een dergelijke claim, hoeft hij alleen maar een autorisatieformulier in te vullen en “klaar is Kees”

De website van deze Berlanga Contreras http://berlangacontreras.com werd geregistreerd in maart van dit jaar, en verrassend is wel dat de web alleen beschikbaar in het Engels.

Een persoon wordt op de website gepresenteerd als “Berlanga Contreras” zelf, een naam die eigenlijk 2 achternamen zijn en de voornaam ontbreekt in alle tekst en uitleg.

Contactgegevens zijn:

Er is geen advocaat of advocaat in Spanje onder de naam Berlanga Contreras.

Er is geen dergelijk kantoor, die elke maand meerder claims aangeven bij de rechtbanken!

Het enige wat u kunt verwachten van deze Berlanga Contreras is een verzoek tot betaling nadat u het machtigingsformulier heeft ondertekend en zij zullen niet stoppen met het vragen naar geld totdat u beseft dat het een fraude is.

Stuur alsjeblieft geen getekende documenten naar een “advocaat” die zomaar ineens belt en geef geen verdere persoonlijke gegevens aan de beller, aangezien u niet weet waar deze kunnen komen.

Als een “werknemer” van Berlanga Contreras met bovenstaand verhaal u benaderd heeft, vanaf het mobiele nummer +34 603337074 of misschien een ander nummer, laat het ons dan weten.

Have you spoken to a lawyer called Berlanga Contreras in Madrid?

A new strange cold calling lawyer has been brought to our attention, using the name of Berlanga Contreras.

For the moment this lawyer’s office, supposedly based in Madrid seems to be targeting only Dutch / Flemish speaking timeshare owners, but this could be extended to other languages.

The person calling on behalf of Berlanga Contreras is using the name of Jeroen Bosch.

He explains to the Timeshare consumers that the lawyer’s office Berlanga Contreras has been filing claims against timeshare resorts on a monthly basis, and they are winning them all! How successful can you be?

If the timeshare consumer wants to join such claim all he needs to do is fill in an authorization form and they are in.

The website of this Berlanga Contreras http://berlangacontreras.com was registered in March this year, and surprisingly only available in English.

A person is presented on the website as being “Berlanga Contreras” which are actually 2 surnames and the first name is completely missing in the text.

Contact details are:

There is no lawyer’s office or lawyer in Spain by the name of Berlanga Contreras.

There is no such office, putting claims into the courts each month!

The only thing you can expect from this Berlanga Contreras is a request for money after you sign the authorization form and they won’t stop asking possibly until you realise it is a fraud.

Please do not send any signed paperwork to a cold calling “lawyer” and do not provide any further personal details as you don’t know where these might end up.

Cette semaine a vu beaucoup de plaintes et demandes de renseignements concernant une autre compagnie vocation de revente à froid par le nom de Inmobiliaria Idealia.

Inmobiliaria Idealia contacts multipropriété parlant français propriétaires par appel à froid et leur raconter une histoire au sujet d’un acheteur d’entreprise qu’ils ont déjà en attente, vif sur l’achat de leurs semaines, et le prix offert est bien sur le prix de marché actuel.

La société qui étaient censés acheter les semaines à temps partagé de tous les consommateurs est SEAT SA, mais le fait est que cette société ne sait rien de tout cela.
