Beware of cold caller (fake) Larios Cinco Abogados

A new cold caller with fake stories about awarded money has been brought to our attention and they are using the name of Larios Cinco.

The initial cold call is received from a man called Daniel Fuller, who presents himself as an agent from the company Larios Cinco.

This man is calling from a Spanish mobile number 0034 672530964

He explains that the purpose of the call is to make the consumer aware that he has been awarded a substantial amount of money following some ruling in the Malaga High court.

Unknown to the consumer, he seemed to be part of a “Class Action” against a holiday company with over hundreds of other victims/claimants and the court awarded each victim around 15.000 Pounds.

In order to get the awarded money transferred to the consumers’ account, the agent from Larios Cinco asks if the consumer has received the documents that he needs to sign.

If the consumer did not receive anything, Mr. Fuller assures they will send out another email with the electronic version of the documents.

But the agent of Larios Cinco also explains another issue which needs to be solved.

Apparently, there is an Embargo by the Spanish Government, and the consumer needs to call the Malaga High court on another Spanish mobile number 0034 611351717 and ask for Peter. This Peter works in the “Expat” office and he will explain everything about the “Embargo”

The story doesn’t finish there as more calls are received by the consumers from the same set up. A Mr. Robert Cook also contacts the consumer with a story about being the head of accounts and the person who will verify the documents and organize the money transfer.

Although after all these calls and overload of information they haven’t asked for any money yet, it certainly becomes clear where this is leading to.

Keeping in mind that there are no Class Actions at all in Spain and certainly nobody gets money awarded just out of the blue without even knowing they were part of a court claim.

That is ridiculous!

So, for as much as they want to make this appear a genuine story with all kinds of employees involved in the pay out to the consumer, don’t let these calls blind you!

If you receive calls from Larios Cinco or any cold call about awarded money you were not expecting, please let us know.

Did you receive an unsolicited call or email from Timeshare Consultants.org?

A new company has been brought to our attention as they are sending out some very strange emails.

This company is called Timeshare Consultants and they claim to have offices in both Spain and UK.

The email message received from info@timeshareconsultants.org  is as follows:

Dear xxxxx

I am writing to inform you that we are currently holding compensation that has been rewarded to you, to the amount of £28,990.00. Your compensation has now passed all security checks, we have now been given authorisation to release it from our accounts and finance team. In order for me to release your funds today, you must pay our overseas tax fee which is 10% of your compensation (£2,899.00). Once this has been confirmed by our agent we will release your monies immediately.

Kind regards Peter Nixon

0203 769 3071

Obviously, it is impossible that any money is awarded to you if you never actively joined a court claim, which needs an appointed lawyer to act on your behalf and the documented evidence that indeed you have been defrauded.

There is no such thing as court claims or class actions done and then the victims are being notified out of the blue and can just collect the “awarded money”

The website mentioned in the email http://www.timeshareconsultants.org/ was registered on 13th of January 2021 and is due to expire in 12 months.

There are actually no company registration details on the website which constitutes a lack of transparency.

Email Address: info@timeshareconsultants.org

If initial contact with Timeshare Consultants was unsolicited, a cold call or email out of the blue, it should certainly be treated with caution. Your personal data cannot be obtained without your permission, so there should be a clear explanation from them on how they obtained these details.

If you have been speaking to any of the agents of Timeshare Consultants or maybe you received a similar email as the one copied above, please let us know.

Who paid money to Armando Orebandel Jurados y Notarios?

Sometimes consumers have been defrauded but it takes them some time to actually realize this. But that doesn’t mean that the fraud they have fallen for wasn’t a vile scam which left them out of pocket.

We are now receiving inquiries from concerned consumers who paid certain set ups in the past and never heard anything back, and they are now at the stage that they know it was all a scam.

One of these set-ups were the fake lawyers from Tenerife. The group of numerous companies with fake names and fake claims, supposed awarded money that never reached the victims and thousands of euros paid into fake lawyers and notary accounts.

One of the last active fake notaries was Armando Orebandel Jurados y Notarios.       A company that doesn’t not exist and nobody by the name of Armando Orebandel is a registered notary in Tenerife or Spain.

They even went to the trouble to create a website in order to give it all a more credible image; www.armando-orebandel.com  The web is no longer available.

Names used in the documentation send off by the offices of Armando Orebandel Jurados y Notarios were Caroline Merrick, Simone Nando Martinez, Ramon Quentin Cansal or Adam Antonio Ugray.

Email address used: jurados_orebandel@europe.com

This is not a warning about  Orebandel Jurados y Notarios cold calling or contacting you now. We do realize they have vanished or at least they are no longer acting under these names.

But we do want to hear from you, the consumer that has been defrauded by these people.

If you spoke to Armando Orebandel Jurados y Notarios or any of their supposed employees / associates in the past, and worse even, if you paid them, please let us know.

Did you receive an (unsolicited) email from Timeshare Word?

We have received from various consumers an inquiry about a website called Timeshare Word.

The first contact is through an email, and they mention the following:” You are receiving this email because you opted in via our website”

Still, none of the consumers who contacted us seem to recall having opted for this through any website at all.

In the email they invite the consumer to visit their website as they provide information for when their resort closes down, how to claim back maintenance fees or claiming through the courts.

The website www.timeshareword.com shows different articles on the front page and then they have tabs for who they are, resale services etc.

There is a tab for their “competition” which as they explain has at the moment a different prize due to the covid restrictions, but in the future, they will give away “accommodation in a luxury resort”.

One of the rules to join the competition is:

  1. You must own a timeshare product. Proof of ownership will need to be provided in order to claim your prize.

So, they set up a blog for timeshare owners who want to exit, sell or claim but their competition can only be entered if you own a timeshare.

Why would that be? Are there any other terms and conditions attached to the “luxury accommodation?”

The website was actually registered in September 2020 and they only took out the domain registration for 1 year.

Timeshare Word is not a registered company and they present themselves as a non-profit Organisation created by timeshare owners in order to help owners understand what is going on in the timeshare world.

Let’s see how this evolves over time.

If you have contacted Timeshare Word for any of their services, we would really like to have your feedback.

Who are the people behind Timeshare Registration Office?

We are receiving inquiries from concerned consumers about cold calls from people claiming to be calling on behalf of the Timeshare Registration Office.

Although this might sound “official”, in reality the name raises our eyebrows straight away as there is no such thing as an office where all timeshare is registered.

Neither is there a company registered by the name of Timeshare Registration Office.

Most of the calls are coming from the number 01246891100 but some people mentioned different numbers from the Chesterfield area.

The agents calling from this so-called office are offering claims assessments and cancellation procedures, but it becomes soon clear that it isn’t them who are going to deliver these services.

Soon as they notice the slightest interest of the consumer, they divert them to a company in Mallorca and they are keen to arrange a zoom meeting.

This seems to be a way around the fact that cold calling should not be admitted for offering legal services, and the claims companies not wanting to be classed as cold callers.

Although cold calls on itself are not illegal, they are breaching the law when the caller is not really “cold” calling. Companies such as The Timeshare Registration Offices are consciously targeting the consumer as they seem to have private details from the consumers such as contact details, where they own their timeshare etc.

That information is not open to anybody and is exactly the information that is protected by the Data Protection Law!

So, using client information which has not been provided by the consumer, is in breach with the law.

Any claims/legal company accepting clients who have been approached on cold calls, are therefor in breach with this law as well.

This can actually be reported with the government and any company involved in offering services through cold calls, even if they are the second in line or maybe third, should be reported.

Mindtimeshare will be assisting consumers who want to report companies that cold call them and obviously are in breach with the Law on Data Protection.

If you have received a cold call as well from the Timeshare Registration Office or any other company offering you services regarding your timeshare and holding your private information, please let us know.

You may contact us at customercare@mindtimeshare.com

Have you been speaking to Referral Consultancy about “walking away” from your Timeshare?

A new cold calling company has appeared under the name of Referral Consultancy.

The agent from Referral Consultancy, Julie Diarra informs the consumer about their service on a No Win No Fee basis, that can enable the consumer to “walk away” from their Timeshare Ownership.

Once the consumer has shown his interest in this service, the agent from Referral Consultancy confirms the details in a follow up email.

In this email Referral Consultancy states they will endeavor to arrange a no win no fee claim for the consumer. This will be done by creating a viability report based on the copies of the documents the consumer needs to forward to them.

The documents are required in order to be able to identify jurisdiction.

The win no fee claim they offer is depending on creation of this Viability report for their legal partners so they can get confirmation that they will take case on this basis.
They reckon the process can be as quick as 3 months or as long as 2 years. This depends on jurisdiction and membership.

Referral Consultancy assures the consumer that they will not take a claim on unless they know it will be won.

When doing a bit more research about this company we found their website http://referralconsultancy.co.uk which was registered at the beginning of February 2021. That is just 1 month old!

On this website they call themselves “claims validators” and “brokers”, people who will put you in contact with UK Lawyers.

Amazingly they display a number of clients they referred in 2019, which surely must be a typo if they only have been around since February this year. And they also have testimonials from happy customers, and all that in 1 month.

Contact details on the web:

Telephones: Tel: (+44) 121314**82 / WhatsApp: (+44) 7443**1248

Email address: info@referralconsultancy.co.uk

There is no company address or any other company details on display.

There is no privacy statement, so by filling in your contact details there is no guarantee where these details might end up.

If you have been talking to Referral Consultancy, we would like to have your feedback.

Have you received any calls from Key to Paradise?

After a year in which travel got more and more difficult, it was to be expected that the so-called Fly buy operators would cease their calls and business.

But with a ray of light on the horizon for this summer and after, the first calls from these fly buy companies have appeared again.

The latest one is Key to Paradise.

On their website www.keytoparadiseleisure.com they describe themselves as follows: “KEY TO PARADADISE provides its members with exclusive luxury travel concierge services and resorts in the most luxurious and exotic destinations on earth.”

The contact details on their website give an address in Tenerife: Calle del Castillo 14, 38002 Santa Cruz de Tenerife.

But their company registration from September 2020 provides an address in Alfas del pi, which is in Alicante. That’s far away from Tenerife!

Their email address is a Gmail account: keytoparadisealbir@gmail.com

Telephone +34 966 941 755 which is an area code of Alicante as well.

On their web, they also present their team of happy smiling employees, Sara Jones the client manager, Tim Woods the bookings manager and Mark White the entertainments manager. The pictures shown of these people are pictures taken from the Google picture database and used on hundreds of other websites. These people on the pictures are certainly not involved in your holidays!

There is no privacy statement on the web from Key to Paradise, so by entering your contact details you don’t know where these will end up.

Neither are there any Terms and Conditions for any of the holiday packages they offer.

Back to the services they offer, they are calling consumers and offer a holiday accommodation package for just 199 Pounds. In some of the calls they even mention about previous companies that approached the consumer and sold them similar packages.

Please remember that cold callers are never to be taken lightly. It is not normal that a company you don’t know, has all the information about you, your name and the holiday-packages you might have purchased in the past. That is personal information and that is strictly protected by law.

It is also stipulated by law that you should be made aware of all terms and conditions prior to buying into any package.

If you received a holiday offer from Key to Paradise, please let us know.

Tranquilitas Legal Consultancy, the associated lawyers from Aegis Direct.

Not so long ago we posted a warning on the blog for Aegis Direct, a cold calling claims company offering timeshare cancellations and supposed legal claims through their associated legal partners.

Initially people were referred to Claim Solutions Group but lately a new name has appeared on the scene; Tranquilitas Legal Consultancy.

As it always seems rather odd that a legal company accepts clients through cold calling companies, we did some research on Tranquilitas Legal and found the following information.

Tranquilitas Legal Consultancy is based in Mallorca. Aegis is in Tenerife, another island but separated by thousands of miles. Why would they associate themselves with lawyers so far away?

The website of Tranquilitas https://tranquilitaslegal.com/ was registered on the 14th of January 2021. That is just 2 months old.

There are no company details on the website, no privacy statement as obligated by law, and no details of any lawyers working in this company.

The information provided is all very general and vague although they claim to be the timeshare legal specialists. Strange nobody ever heard from them before.

For contact details they use different emails, depending on the agents who send the email:

sabina@tranquilitaslegalconsultancy.com

natalie@tranquilitaslegalconsultancy.com

Free phone number: 0800 920 2453

In their emails they do mention an address:

  • Carrer Can Serinya 5a
  • Palma de Mallorca
  • 07003
  • Spain

The picture shows what the actual address looks like on Google street view.

Please, we cannot stress enough, genuine legal companies do not cold call. Genuine companies do not obtain your personal details from dubious sources to use them for offering their services.

Your personal details are not available in any register or database that can be accessed by any company.

On the phone people are promised the moon, they will get all their money back, even with high interest rates, double refund, you name it they will say you will get it.

But reading through the agreements most of the times all they commit to is a cancellation of the timeshare! Something you can perfectly do on your own and with the resort directly.

Throwing in names of supposed legal companies such as Tranquilitas Legal Consultancy should not refrain you from doing a proper research on who this company is, and if they really do claims and how many they have already successfully finalized.

Careful who you speak with and who you share your private details with. You don’t know who they are!

If you need to more information, please contact us: customercare@mindtimeshare.com

Mindtimeshare Active Companies February 2021

Dear Consumers,

February 2021 was a short month, so here we are yet again with a list of active companies offering all kinds of services to timeshare consumers on cold calls, emails or through “referral” of the same.

We see it happen far too often now that people are cold called or emailed and when they show the slightest interest, they are quickly referred to another company.

Should we then not name the second company on this list or the third or fourth?

They are all in the same game!

In the month of February 2021, we counted a total of 37 active companies of which 11 companies were new ones.

For a complete list of Active companies in February 2021 and links to the blog articles we wrote about them:

Mindtimeshare Feb 2021

The names of the 11 new companies are as followed:

  • Alpha Consulting
  • Caridad Garcia Procuradores
  • Financiera Oficial ES
  • Geros Abogados
  • Marketing Solutions Group
  • MSG
  • Premium Breaks
  • Referral Consultancy
  • The Advisory Team UK
  • Timeshare Word Advisory
  • Tranquilitas Legal Consultancy

As you will notice, most of the companies on the list are so called claims companies.

As we have pointed out in one of the articles, we posted this month, please be careful with the half-truths they are telling people in order to get them to sign up for their services.

Read the article on the following link: https://wp.me/p1kmoi-429

We cannot stress enough about the risk of engaging with cold calling companies.

Not just because the company seems to know all your details and even payment details from the past, they are to be trusted and they are who they say they are.

The contrary! Nobody should be holding your private and personal details without you having given your consent for this.

Cold calls on itself might not be “illegal” as such, but if the cold caller is holding your private information and is using this to sell you their services, that cannot be branded as legal. Neither can it be called a cold call, at least not for their side!

The latest “pitch” we have noticed as well among these cold calling claims companies, is that they tell the consumer that even though they relinquished their timeshare many years ago, the resorts are now chasing the members for outstanding fees mounting up to thousands of pounds.

This is complete nonsense, and really if you relinquished the membership and have this confirmed by the resort, don’t let unscrupulous cold callers scare you with these stories.

We try to place warnings on our blog the soonest we receive the information from consumers and have been able to do our investigations.

Therefore, it is very important to us that you let us know straight away when receiving dubious calls or emails with offers regarding your holiday ownership.

Always do your homework and ask for more information before paying to a company that contacted you without you having asked for it.

For as much as they are registered, for as much as they sound knowledgeable, plausible and even professional, there is no reason why you cannot take your time to get more information about them before paying thousands of euros/ pounds.

And remember, we are here to help!

Timeshare claims, do they really think TUI can be made responsible?

Not a day goes by without consumers asking us about claims, and of course their own possibility to claim.

Most of the times they ask because they have been on the phone with yet again another company promising the moon and explaining how easy it is to get their claim done in no time and walk away with thousands of euros.

The fact that most of these company’s cold call, does not always ring an alarm bell with the consumer, while this should really be the first warning sign.

Cold calls are not allowed under the current Data Protection Law, and certainly there are no lists or databases of timeshare owners, accessible to anybody to extract the information and start calling!

Then there is also the misinformation which is telling people “half” truths, statements based on real facts but with additional facts that are based on nothing and used to convince the consumer they can claim or even that they have to claim.

Example of these half-truths is the statement recently posted on the Internet: ‘TUI was the owner of Anfi between 2001 and 2004 so really you can claim your money back from TUI.”

Statements like this don’t seem to be based on actual facts. These are weak arguments to push confused timeshare consumers towards a claim for which they need to pay thousands of Euros upfront and the outcome is not that guaranteed as they have been told on the initial call or zoom meeting.

Don’t get me wrong, nobody is denying here that there are claims in court. That is jurisdiction, that is the law.

But letting consumers believe that “everybody” can claim, even when they purchased in a completely different era, a different product or from a different sales company, that is misrepresentation.

Coming back to the TUI story, we are not sure what the actual intentions are behind these statements. TUI was the owner of 51% of Anfi, so at the same time why would you not say you could claim back from the other half who owned it as well?

Maybe because TUI sounds familiar in the ears of the consumer? Maybe when people hear TUI they think, ‘yes, there is still money to claim back’

But why was TUI never mentioned before in any of the court rulings for those consumers who actually bought between 2001 and 2004?

Surely a judge would be more than clear on who should be paying the money when the ruling is announced?

If TUI were legally responsible for the sale of the contracts, as they were the controlling body of the Anfi Group, why was this never noted before by any judge?

Are they insinuating the judges have “overlooked” this detail all the time?

Or is it because TUI was not the sales company mentioned in the purchase agreement?

We have seen these court claims for several years now,

But, why pointing the finger at TUI at this moment in time? What is the real reason behind this article about TUI right now?

Have the claims companies run out of clients or convincing arguments to get the Anfi owners on board?

The article isn’t very clear either, as after making all kinds of statements and mentioning rumors why TUI left Anfi, they change the tune of the article and state ‘This may also mean they are also liable for the claims against Anfi…’

‘May’? So, after all nothing is that sure?

You ‘may be able to get your money back’ is not really good enough when you are expected to pay close to 10k upfront.

Of course, the court claim is never guaranteed, but certainly after all these years of claims it sounds very unlikely the judges overlooked the TUI liability.

Please, when you are considering claiming against your resort, whatever resort it is, do get the facts right before making any decision on who to go on board with.

Aegis Direct, the claims company which was selling holiday accommodation before.

One of the most active cold callers at the moment is a company called Aegis Direct. Not always are they using the name of Aegis Direct on the first call, it can also be Marketing Solutions Group.  But straight after the first call the consumer starts talking to Aegis Direct.

Aegis Direct offers cancellations of timeshare memberships with a refund claim which will be done by their “legal partners”.

For this service they ask around the 10.000 Pounds.

In order to explain the services to the consumer they arrange for a zoom meeting, and if the consumer is interested a deposit of 1000/1500 pounds is taken straight over the telephone.

Consumers commented that the people on the call are very knowledgeable and the calls can take a couple of hours. By taking the deposit straight there and then it does mean it doesn’t leave the consumer with much time to do any further research of verification of all the facts they were given during the call.

One of the things that caught our attention with Aegis Direct is that they seem to target the people who previously dealt with companies such as Planet Sunlight, Claim your claim, Debenesse, Poplis, Pantare, etc.

A dubious group of compnaies offering claims to consumers, who had to travel to Tenerife to discuss their claim but who ended up after hours and hours of meeting, signing for accommodation agreements and paying close to 10.000 Pounds.

This group disappeared a couple of years ago, leaving behind a large group of consumers who only then realized their money was gone. (Read what happened: https://wp.me/p1kmoi-3Ge)

With a bit of research, we found that Aegis Direct is registered at the Spanish Companies House. And they have been since April 2019. But surprisingly they didn’t start with the name of Aegis Direct, but it was Poplis AZ. This was one of the companies mentioned above who disappeared and never delivered the services to all the consumers travelling to Tenerife for a claim.

And now we have Aegis Direct, offering claims.

Another detail of the company’s house registration is the nature of their activities, or “sector” of their business. This is registered as PRODUCTOS / ACTIVIDADES DE OCIO / PELÍCULAS. This means, Products, Leisure activities and Movies.

Not really an activity you expect from a company offering claims and timeshare disposals.

Going back to the services offered, the agreement received by the consumers, states clearly that the services are for “nullification of timeshare membership”.

Nullification obviously means cancellation or disposal.

Although in the paperwork there is a mention about a possible claim through a third-party legal company, there is no guarantee at all there will be a claim.

A resume is included of all the money paid by the consumer to the different holiday clubs/resorts and dates on which they paid. This document is called the Owners Purchase Timeline and in bold they state clearly there is no guarantee and work will be undertaken on a speculative basis. If the claim is successful, and paid out to the consumer, there will be a charge of 25% plus VAT over the awarded money for the legal partners in the 7 days of receipt of the refunded.

This might sound very re-assuring and creates the sense of not taking any risk, after all if you don’t get a refund you don’t pay the legal partners. But please don’t forget you already paid around 10k upfront!

And paying all that money for a simple “nullification” (relinquishment) seems rather expensive.

Obviously, the consumer is the one to decide but reading through an agreement and checking on everything that the agreement commits to and what not, might be recommendable before paying.

If you have been in contact with Aegis Direct and want to share your feedback with us, please let us know.

You can reach us at: customercare@mindtimeshare.com

Did you receive an invoice through Financiera Oficial ES for outstanding legal fees?

Several consumers have been receiving dubious calls from a person claiming to be working in a Notary in Madrid.

The person calling is Anna Hernandez and she explains to the Consumer that he has have awarded £27,000 from a court in Madrid. In the first call, Anna Hernandez does not ask for money, but she does need some kind of ID from the consumer, so she kindly asks to forward copy of Passport or Driving License.

But after receipt of the copies, all of the sudden there seems to be a charge if the consumer wants to proceed. A 10%over the awarded money, in concept of outstanding legal fees.

The legal fee’s cover court costs, all work carried out by the lawyers, translation of documents, paralegal work and notary involvement.

Still, taking into account the consumer is about to receive £27,000, why not pay the £2,700?  Well, at least this is what the fraudsters pretend the consumer will do!

The invoice received comes in the name of Financiera Oficial ES, which is an entity that does not exist at all.

The address on the invoice is of the courts in Madrid.

The amount to pay is in Pound Sterling, which makes no sense in a Euro country such as Spain.

But to take all doubts away, the caller assures the consumer that this fee will be reimbursed from the guilty parties and this will take between 6-8 weeks to process.

But the actual awarded amount will be paid out in 72 hours after receiving the payment of the fees.

Somebody from the accounts department will be contacting the consumer in order to arrange for the payment to be done.

Yeah, right!

Please do not fall for this as we can assure you that you won’t get any payment after 72 hours, neither will you get the paid fees back after 6-8 weeks!

If you have been contacted by Anna Hernandez or anybody else claiming they are from a Notary in Madrid or Financiera official ES, please let us know.

Has Geros Abogados won your Court case without you even knowing them?

Yes, we have another FAKE lawyer’s alert and this time they go by the name of Geros Abogados.

Careful! Those trying to do their homework and looking up the company at the Spanish Companies House will indeed find a Geros Abogados registered, but this company has NOTHING to do with the cold callers you are talking to.

It’s not the first time consumers receive communications with names and details from genuine companies. This is of course done on purpose and will confuse the consumers even more.

Who can they trust?

But you need to look at the other details as well, and for sure there will be things that don’t add up.

This time we have a letter from the “Ministerio de Justicia”, forwarded by Geros Abogados stating that they have prosecuted a company the consumer paid money to in the past, and the consumer amongst 130 other claimants have won compensation in the sum of £21.350 through their, no win no fee basis.

That sounds like tremendous, good news. Especially if you never knew you were part of a claim, it’s like money falling from the sky!

Of course, the letter has a logo of the Ministerio de Justicia (Court of Justice) and the logo of the lawyer’s company. But how difficult is it to copy this from the internet?

What doesn’t look very genuine is the email address: gerosabogados@protonmail.com, which is an address set up on a free server. This is certainly not something a genuine legal company would do, and any company nowadays has their own domain, web and email.

In the letter they mention the official wording of the supposed ruling which states: The accusations of fraud by way of deception, gross miss-conduct and miss sold products and services, have been brought to the tribunal superior de justicia sala de lo social de Madrid Num 1 commison xxxx (consumers name and address details).

So, a company has been brought to court, and accused of fraud and all this without the consumer (Claimant) knowing this.

Please, this is all a scam and we certainly do not recommend engaging with Geros Abogados any further as they most probably will come up with all kinds of fees, taxes and payments before you can receive your awarded money.

If you also received a letter from the Ministerio de Justicia through Geros Abogados please do let us know!

  • Consumer Advice Helpline
  • J & A Resolutions
  • Melbury Green
  • Navarro Properties
  • Timeshare Support Group

Most cold callers are offering claims against resorts and claims to recover the money the consumer paid to fraudulent companies in the past.

Please note that these people should not have your personal details in the first place!

Genuine lawyers do not cold call and neither do they hire companies to do the cold calling for them. Neither do they request a fee for subscription or registration.

Companies that offer to recover defrauded money, are most of the time offering a recovery where unfortunately this is not possible at all.

You cannot claim back money from companies that went bankrupt years and years ago (DWVC, ILG), companies that simply vanished, etc. In most cases the only way to recover the money is under the consumer act, which is when you paid by credit card. It depends on the time that has passed since the payment and the circumstances to see if you would be in the position to claim.

But if you are, you can do this yourself and you don’t need to “hire” a cold calling company for this.

In case of doubt, please do contact us. We can give you advice on how to do a consumer act claim.

If you receive a cold call from somebody offering you a service related to your timeshare or holiday membership, then we would like to hear from you.

Have a great February!

Did you receive a call from Inconel Administration?

More and more consumers are writing to us about unexpected calls they are receiving from a company called Inconel Administration.

The agent from Inconel Administration presents the company as a law firm, working out of Malaga and helping consumers with recuperating their money through the Spanish courts.

Money paid to bogus companies in the past or for different holiday memberships.

This agent from Inconel Administration seems to have all the details of the payments, amounts, dates and names of companies.

It is explained to the consumer that they could do such claim themselves, using a lawyer in Spain but then they would need to travel to Spain and not only is this very costly it would also be very time consuming.

By using the services of Inconel Administration, this hassle is all taken away.

The consumer is assured of a free assessment of their claim by one of their lawyers.

But throughout the conversation there is a mention of a 340 euros court fee, which will be needed to get the process started.

The follow up email which is send to the consumer after the first call, shows a resume of all payments they made to bogus companies, and the charges Inconel would apply.

Strange enough there is no mention of the court fee any longer and now it shows as “registration costs plus 21% IVA (VAT)”

It becomes clear that the consumer is expected to pay this fee, weather it is a court fee or registration fee, before they speak to the lawyer or receive the mentioned assessment.

Doing a research on the actual company Inconel Administration we have found the following information.

The company is registered at the Spanish Companies House since August 2019.

The address mentioned: C/ VICTORIANO BEAMUD 18 (ARENALES DE SAN GREGORIO), CIUDAD REAL.

The administrator of this company appears to have more companies under his name and looking at the other companies we have found some very familiar names: Fastline Legal Services, Greenges 2005 and O1C Leisure and legal Solutions.

Although they don’t mention any branches or range of offices, there seems to be more than one address for Inconel Administration:

  • Calle Aribau 170, 1º, 2º 08036 Barcelona.
  • Plaza de la Iglesia Local 9 planta 2 primera puerta, 29631 · Arroyo de la Miel · Málaga
  • c/ Coronel Ripollet Edif Santos Rein 3A · 29640 · Fuengirola, Malaga, España

They all have the same telephone number 0034 951 120 044

Email address: info@inconeladministration.es and info@inconel.es

If you have been contacted by Inconel Administration with the offer for a refund claim through the Spanish courts, we would like to have your feedback.

The saga continues with The Solutions Group and the associated (fake) lawyers.

The Solutions Group is still actively entertaining consumers with their stories of court claims, awarded money and pay outs in different installments.

We heard about consumers who were approached by Solutions in 2019 about a potential reward for a holiday product they purchased years before.

Some people received calls; others received a letter where The Solutions Group explained that the Spanish courts had instructed CUC Abogados to enact to get their money.

Of course, nothing happened, there couldn’t be as CUC Abogados is a complete fake and fraudulent company!

We warned about CUC Abogados, or Caneillo Utierros Ciusapi Abogados and you can read this warning on the following link: https://wp.me/p1kmoi-3CY

Consumers who didn’t fall for story of CUC Abogados, were then approached again and referred to another fake company called Perez Alonso Abogados y Asesoria.

Another warning was posted on the blog about Perez Alonso and you can read this on the following link: https://wp.me/p1kmoi-3HU

But as it seems now, The solutions Group hasn’t had enough of the consumers’ money as yet, and they continue the saga of the court claims and money being paid out to consumers.

They keep on insisting the claim has been successful and it is actually surprising to see that everybody seems to be awarded the same amount.

Supposedly the awarded money is now waiting there for the consumer in order to be transferred into their accounts.

But of course, another fee has to be paid first.

This time a payment is requested of £477 for translation of documents to complete the case.

The company in charge of the documentation and corresponding translation is Contract Advice Ltd.

The payment needs to be done by bank transfer in the name of this company.

Please note that there are no court claims done by The Solutions Group, and there is certainly no money awarded to consumers just out of the blue which is going to be paid out through their “associated” companies such as CUC Abogados or Perez Alonso Abogados.

And as there is no court claim, no ruling and no awarded money, Contract Advice won’t be doing any translation either!

Please if you are one of the many consumers that have been entertained for years now by The Solutions Group, stop paying them money!

You will not see this back!

If you have been in contact with any of the companies mentioned, do let us know.

You can email us at customercare@mindtimeshare.com or through the contact form on the blog.

Have you received a cold call from the fake Melbury Green for legal services?

There seems to be a lot of cold calls going on lately to old Club Class members promising the recovery of the money paid for their membership.

One of the most recent cold callers is Melbury Green, supposedly based in London.

They seem to have cleverly copied the name and address details of a real existing Investment company which obviously has nothing to do with the cold callers, but it does the trick to confuse consumers.

The caller from this fake Melbury Green is a lady called Juliet Henshaw.

Ms. Henshaw explains the consumer that they can recover the money paid to Club Class through a court claim they are doing with a lawyer in Spain, Mr. Diego Sanchez.

In order to join the court-claim the consumer will need to pay several fees:

Handling fee of £595

A legal fee for the lawyer Mr. Diego Sanchez £649

The actual court costs £622

And a fee to process an NIE number request (Spanish Tax registration number for foreigners) to allow Funds to be sent, without paying 35% Tax.

The good news is that the NIE number can be obtained by Melbury Green in 1 day for £819

Strange thing is that the payment of the handling fee would not go to Melbury Green but to a company called Enterprise Conversions, which is a company that is dedicated to “Maintenance and repairs of motor vehicles” as per their Companies House registration.

Contact details provided for (the fake) Melbury Green are:

Telephone 0207 193 1412 which seems to be the number for Mr. Oliver Dixon who is the “accountant”.

And an Email:  melburygreen@yandex.com which is a free server email account which you can set up in 2 minutes.

Please note that there are no court claims against Club Class and if you would do a court claim you would be doing that with a genuine Spanish lawyer and not with a company registered as repair of motor vehicles in the UK.

The nonsense of arranging an NIE number which you can do for free with the Spanish consulate, is another excuse to get money from innocent consumers.

If you received a call from this FAKE Melbury Green, from Juliet Henshaw or anybody else, please do let us know.

You can email us at customercare@mindtimeshare.com or through our contact form on the blog.
